President Trump Is Stacking The 9th Circuit

Circuit Court of Appeals on Friday, tapping a federal prosecutor and a conservative appellate lawyer for the west coast court.

The nominees, Patrick Bumatay and Lawrence VanDyke, are likely to elicit strong opposition for Democrats. If confirmed, the pair would raise the number of Trump’s 9th Circuit appointees to nine, with one other nomination pending.

Trump has clashed frequently with the 9th Circuit, which upheld injunctions against top administration policy priorities like the travel ban. His criticisms drew a rare rebuke from Chief Justice John Roberts, who rejected Trump’s charge that judges are sometimes motivated by politics.

Friday’s nomination is the latest twist in Bumatay’s meandering path to the federal bench. Trump nominated Bumatay to the 9th Circuit in October 2018 over the objections of California Democratic Sens. Dianne Feinstein and Kamala Harris, but his nomination lapsed with the end of the previous Congress. Thereafter, Trump nominated Bumatay to a federal trial court in southern California. That nomination was pending before the Senate until Friday, when the president changed course and named Bumatay to the 9th Circuit.

With the two retiring Bush appointed judges, Bybee & Bea, there will 11 Republican appointed senior judges and 9 Democratic appointed senior judges.

Senior judges 89 and older: 2 Nixon, 3 Carter, 1 Reagan.

What does the author mean by this? There is a 5th Circuit position and an 11th Circuit position with nominees pending but nothing in the 9th that I see. Also POTUS has appointed 8 judges to the 9th Circuit so far, with Bumatay & Van Dyke the tally will be 10, not 9. Is the author unaware Danielle J. Hunsaker was confirmed?

So sorry. I didn’t notice that it was a September article. Danielle J. Hunsaker was not confirmed when the article was written.

After these two, Bumatay & Van Dyke there will be only 3 Republican appointed 9th Circuit judges that were not appointed by President Trump.

These justices were appointed in 2003 & 2006 by G.W.Bush. They are 70, 78, and 66 years old. Hopefully at least one will assume senior status in President Trump’s second term.

The article states that the 9th Circuit is often in conflict with Mr Trump. Actually the 9th Circuit is often in conflict with SCOTUS.

"This oversight could be the only thing that saves the Republic."

I'm sure (or at least hoping) your statement is in jest, an oversight, or an intentional trolling...

The "Republic" has not existed for about 100-years... There is nothing to "save"...

What President Trump can do, by appointing Constitutional originalists to the SCOTUS, is to provide hope that someday it will be possible to "restore" the Republic without bloodshed...

Examples of initial, bare-bones, tell-tale signs that a "restoration" might be in the gestation stage would be:

These are only a few of the things that might allow restoration of the former Constitutional Republic without bloodshed...

Although if Pete wins, the courts may be packing him.
