Grieving dad jailed for repeatedly criticizing court system in Macomb County

He lost a custody battle, then his son lost his life. He blames the court system. He voiced his strong opinions on social media and the next thing he knew he was locked in jail.

This petition is in reference to Judge Rachel Rancilio’s censorship, abuse of power and violation of a constituent’s right to free speech.

Following the death of Mr. Jonathan Vanderhagen’s son, Killian Vanderhagen (2 Years Old), Mr. Vanderhagen began to criticize the court which issued the ruling refusing to grant him physical custody of his son. Mr. Vanderhagen believes the court responsible, at least in part, for his son’s death. Whether Mr. Vanderhagen is correct in his assertion or not, it is despicable his being jailed over his criticisms of the 16th Circuit and, more narrowly, Judge Rachel Rancilio. The details as reported are as follows;

“Following the death of Killian Vanderhagen, his father, Jonathan Vanderhagen, was incensed that the child was placed in the custody of his ex-wife, who he felt was unfit, and when his child died, he began posting his criticisms of the system, and Judge Rancilo, who he felt was responsible for his child’s death, and promising, “I’m gonna dig up all the skeletons in this court’s closet.” (An investigation did not indicate that the mother caused the death)

The judge claimed to feel threatened, and referred the matter to police, who found no threat, but for “some reason” he was charged with “malicious use of telecommunications services,” and released on $2000 bond.

When he continued his criticisms, his bond was revoked, and now he is sitting in jail on $500,000 bond.”

A $500,000 bond for a misdemeanor with a maximum fine of $1000 points to judicial impropriety, and retaliation- not justice. This bond was set by Judge Sebastian Lucido- another elected Judge. The U.S. Supreme court’s opinion in Weems V. United States (1910) dissented from the lower court based on the principle of proportionality in defense of the 8th Ammendment. We assert that this too is a violation of Mr. Vanderhagen’s constitutional rights.

Finally, if it is Judge Rancilio’s opinion that her interpretation of the law being used to jail Mr. Vanderhagen as well as the way that she is using her power to influence its enforcement is true and just, she lacks the common sense and decency to sit the bench.

We call on the Michigan State House of Representatives led by Mr. Lee Robertson Chatfield, The State Senate led by Senator Mike Shirkey and Senator Jim Ananich, as well as Governor Gretchen Whitmer to begin an impeachment investigation into what actions Judge Rancilio took and to what extent she may or may not have used her position vindictively as an act of censorship and retaliation against Mr. Vanderhagen.

Please join us in preserving the supposed high ethical standards of Michigan’s Judicial and Legislative Branches by taking immediate action and signing this petition.

Jonathan Vanderhagen will be convicted on September 13 due to several Facebook posts aimed at Judge Rachel Rancilio. A resonant story unfolded in Macomb County, demonstrating the abuse of power and the violation of constitutional human rights.

This story began a little over two years ago. When Judge Rancilio transferred custody to an irresponsible mother instead of Jonathan Vanderhagen. According to the grandmother of the deceased boy, Jonathan requested sole custody of the child.

“His lawyer said something is going to happen to this child. You need to get him away from the mother. There are too many red flags. And the judge said, oh that is in the past,” said Deborah Vanderhagen, grandmother of a dead child.

According to a forensic examination conducted after the death of 2-year-old Killian, the cause of death was a previous illness and the police did not find evidence of the mother’s guilt. But this did not suit the grieving father and he blamed the court and judge Rachel Rancilio for everything.

“Dada back to digging and you best believe I’m gonna dig up all the skeletons in this court’s closet,” read one of the publications.

It is reported that Facebook posts only accused of the death of a child, but never contained threats of violence.

Despite the poor morale, the judge took advantage of her position, attracted the police and accused Jonathan Vanderhagen of malicious use of telecommunication services. He was later released on bail.

Jonathan was not afraid of the power of officials and continued to write angry posts on social networks. This fact infuriated Rachel Rancilio and now the depressed father is being held in prison. The bond is 500 thousand dollars.

Sounds draconian. I really have very little understanding of law but it appears this bill could always find”intent” and have a person locked up for a felony as the law can be defined as “intent?”

Example: “That person got in my face and used a meme on social media with INTENT to do bodily harm.” Is this the crux of it or am I wrong on McSally/Schiff law

Michigan Judicial Tenure Commission

What the Commission CAN Do

The Judicial Tenure Commission is the independent state agency responsible for investigating complaints of judicial misconduct and judicial incapacity, and for recommending discipline of judges by the Michigan Supreme Court. Its jurisdiction includes all active judicial officers, as that term is defined in the Michigan Court Rules.

The Commission’s authority over judicial officers extends beyond the person’s tenure in office if one of two requirements is met. First, if a Request for Investigation is filed while the individual holds the judicial position, the Commission retains jurisdiction even after the person leaves office. Second, if the conduct in question is related to a person’s judicial office, the Commission has jurisdiction over the individual regardless of when the Request for Investigation is filed.

Judicial Misconduct

The Commission’s authority is limited to investigating alleged judicial misconduct and, if warranted, recommending the imposition of discipline by the Michigan Supreme Court. Judicial misconduct usually involves conduct in conflict with the standards set forth in the Code of Judicial Conduct. Some examples of judicial misconduct include intemperate courtroom conduct (such as yelling, rudeness, or profanity), improper communication with only one of the parties in a case, failure to disqualify in cases in which the judge has or appears to have a financial or personal interest in the outcome, delay in performing judicial duties, and public comment about the pending case. Judicial misconduct also may involve improper off-the-bench conduct such as driving under the influence of alcohol or even soliciting money on behalf of charitable organizations. The allegations made in each grievance are considered on a case-by-case basis in accordance with the Code of Judicial Conduct.

Practically speaking, that's what we've done for the past 28 years prior to POTUS Trump. The problem is that there is no such thing as an honorable representative in the GOPe. Bush, Sr; jorge busho; etc.

The odds are severely stacked against us and after Trump leaves, doesn't appear it will be any different.

Then the Michigan CJC is a rare exception. The Washington state and Texas CJCs only serve to conceal most judicial corruption.

In Washington, the CJC admitted to me that the members of the state Supreme Court have denied my constitutional rights to due process, yet the commission decided they didn’t do anything wrong.

Totally off topic, but your post about people not knowing who you are made me think of one of my late husband’s stories about working for MA BELL.
He worked graveyard, and spent the night checking to makes sure the phone cables were working ok.
One night he happened to tap into a line while a guy and gal were comducting a steamy “on line” affair. At one point in their conversation, the man told the woman, “Thank goodness no one knows about us but you and me.”
“And me”, said my husband before quickly quickly plugging into another line.
