Rape hoax or not, we can be guaranteed that the left will be in the streets if they think they will lose their SCOTUS majority. And I’m not entirely confident that McConnell will even want an originalist majority. Don’t forget that the fake conservatism of the political establishment is just a cover for the GOP edition of the welfare/warfare state. And of course plan B for the Dems is impeachment of Kavanaugh, Plan C is declaring all of Trump’s judges Russian agents, plan D is increasing the number of SCOTUS justices. Etc etc.

If there’s one conservative and one “liberal” on the Court, unanimity is rare. Limiting the number of cases they can accept would seem to be an engine for allowing worse lower court decisions - of the Ninth Circus variety - to stand.
