It’s not a firm rule, it’s the so-called “Biden Rule,” which is something he announced one day. It’s more of a guideline.
Even if you accept the Biden rule, it doesn’t apply if the Presidency and Senate are held by the same party.

There is no rule mandating that. When McConnell held Merrick Garlands nomination because it was an election year lame duck. McConnell referred to it as the Biden Rulebased on JBs position in the past.

It was an excuse for not acting when Biden's Democrats held the Senate and Bush was in the WH. It was repeated when Obama was in the WH and the Republicans held the Senate.
It's not a rule, it's an exercise in Constitutional power.
(However, I wouldn't be so quick to write RBG's obituary -- she's tough old lady and if her cancers were aggressive tumors she wouldn't be here now.)

McConnell has clearly stated that if there is a vacancy, he will move to fill it. The problem is with the Senate Judiciary Committee chair Lindsey Graham, who says he will not push a nominee through in 2020. We will see if Graham can be brought to heel.
