Judge Orders Ethics Training For Michael Flynn’s Former Lawyers

In yet another surprise development in the Michael Flynn case, on Tuesday Judge Emmet Sullivan ordered Flynn’s former Covington and Burling lawyers to appear in court to receive a lecture on ethics from the senior legal ethics counsel for the District of Columbia Bar. While Sullivan’s order expressed concern only over Covington and Burling’s delay in providing Flynn’s new attorney, Sidney Powell, access to his complete legal file, given recent revelations, one must wonder whether Sullivan is equally concerned that a conflict of interest existed in Covington and Burling’s representation of Flynn.

Tuesday’s order followed a briefing by Powell and federal prosecutors on the possible effects on Flynn’s sentencing of recently unsealed court records in the criminal case against Flynn’s former business partner, Bijan Rafiekian. Flynn, who pleaded guilty on December 1, 2017 to making false statements to the FBI, awaits sentencing before Sullivan.

At a status hearing last month, the attorneys informed Sullivan that Flynn was scheduled to testify in mid-July at Rafiekian’s trial. But then last week, the judge presiding over Rafiekian’s trial in a Virginia federal court unsealed various filings, including a motion by the government seeking to brand Flynn a co-conspirator. It also stated that the prosecution will no longer call Flynn as a witness.

It appears that General Flynn's attorneys were working against their client's best interests.

And the Judge is aware of it.

Flynn should sue them for malpractice.

. . . but not necessarily unusual for Judge Emmet Sullivan.
The judge is sending a message.
This judge will do that. He has gotten restless with Deep State behavior.

Sorry to say this but you all overreact to legal developments with which you are not familiar. You forget this is the judge who started accusing Flynn of treason and the Mueller team had to step in to protect Flynn.

If I had to best characterize judges, it would be to say they don’t care. Perhaps that’s for the best but they don’t care about the interests of the participants.

Having kept track of the Judge's actions and declarations during the course of this trial, he seems eccentric aka wacky.

on its face, the covington and burling lawyers seem to be in some way incompetent or at the very least, caught legally off base...(??)

It’s hard to comment on this drama anymore because nothing makes sense in all these legal proceedings. Flynn made his plea deal more than a year and a half ago. He still hasn’t been sentenced, and now the prosecutors are saying he won’t be called as a witness in the other case ... which was the reason they gave for delaying his sentencing for all this time!

I’m a CPA that has to practice under certain ethics rules which address the issue of returning documents to clients. There is no requirement for me to return documents that I have prepared or that the client has prepared under my request. This sounds simple but in practice the lines between what is my property and what is the clients property can be murky.

I don’t know what attorneys have for similar ethics but I imagine there may be legitimate questions regarding what documents they must provide and what documents that must be provided. For example, internal memos regarding whether their are any conflicts of interest may be argued that they are not required to be disclosed.

The judge bringing in a ethics expert may simply be his way of addressing legitimate ethical questions.

That is not true.

Judge Emmitt Sullivan advised Flynn not to accept the plea deal from Mueller. The Judge cautioned Flynn that Mueller could accept his guilty plea and then later use it to accuse him of treason in the future.

Judge Emmitt Sullivan is very familiar with Mueller and his dishonest tactics. Judge Sullivan presided in the case of Ted Stevens.

The wording in the judge’s order to Flynn’s former lawyers suggests that they were withholding the documents over a fee dispute.

These are attorneys in an ongoing trial.

The Judge believes the attorneys have been unethical.

The lawyers rules are real clear. You have to give the client the file, especially if he’s a criminal case defendant and withholding the file might impair his ability to defend himself.
