A federal judge has ordered current and former attorneys for President Trumps onetime national security adviser Michael Flynn to appear in court at the end of August.
Judge Emmet Sullivan, the Obama appointee overseeing Flynns case in Washington, D.C., scheduled a status conference for 11 a.m. on Aug. 27 after Flynns new legal counsel said his former Covington & Burling attorneys had not turned over all of the files related to his case.
Sullivan also said he would invite a legal ethics official to the hearing to explain the applicable rules
In light of the representations made by defense counsel regarding the delay in receiving the client files, the Court hereby gives notice to the parties of the Court's intent to invite Senior Legal Ethics Counsel for the District of Columbia Bar to attend the status conference and explain on the record the applicable District of Columbia Rules of Professional Conduct, Sullivan wrote in an order Tuesday.
In a filing on Thursday, Flynns new attorneys Jesse Binnall, Sidney Powell and William Hodes wrote that they do not yet have the entire file from Flynns former lawyers and said they had been advised it will be several weeks before all the information can be transferred.
Flynns attorneys also reiterated that they already have a massive amount of files to review spanning four hard drives that exceed 253 gigabytes of documents and noted they had identified crucial and troubling issues that should concern any court without going into detail.
Flynns former attorney Robert Kelner told The Hill in a statement: Since the end of its representation of General Flynn six weeks ago, a team now consisting of 24 Covington lawyers has been collecting and transferring hundreds of thousands of documents to General Flynn's new counsel. ..

Sullivan must still be pissed off that the prosecutors in the Ted Stevens case were not disbarred as they should have been. Inviting the Senior Legal Ethics Counsel from the D.C. Bar Association is meant to make sure Flynn’s first attorneys and the prosecutors don’t escape punishment this time. This “invitation” is not an invitation that can be refused.
And just why would it take 24 lawyers and six weeks to assemble all the documents in Flynn’s unless they are going to try and remove significant portions that implicate the former attorneys in a conspiracy against Flynn?
Judge Sullivan doesn’t trust prosecutors to play fair. In reality, you couldn’t ask for a better judge except for Judge Royce Lambreath.

Delay! Delay! Delay! This is all a clear example of “running out the clock.” Until Flynn is sentenced, he has a GAG order, and cannot disclose anything. Which is the real purpose of this whole exercise.
Just look at the truth that came out from Papadopolous after he served his bogus sentence. That’s only a fraction of what Flynn knows.
You think Powell is deep state? Her team asked for the delay.

I do not understand that either, should be a simple matter to just turn over Flynn’s case file to Powell, no need for review of any sort other than making sure entire file is transferred. Don’t see why 24 lawyers would be needed.
Flynn was Ground Zero in the attempt by Obama to take out Trump. The groundwork laid by Sally Yates and the intelligence community was extensive. Peeling back these layers has been quite a task.
Sullivan has fend off the Flynn prosecutors numerous times in his court room and given Flynn every right to fire his first set of attorneys and in early July accepted the new Flynn attorneys request for delay, related to the huge number of documents to review from the beginning and because there are many more coming they have not received.
In order to better serve Flynn, this was a duty filled request by his new attorneys and a no-brainer for the judge to cover the request with his consent.
Sullivan, privately, gets plenty of applause from the White House.
Digital transfers of the documents could easily be done by a couple of people in one day. I suspect the old attorneys are going to turn over paper copies in order to make it much more difficult to search the contents.
