Navy SEAL Eddie Gallagher will be reduced from an E7 to an E6 and will receive a cut to his pay and benefits for posing for a picture with a corpse.
Navy SEAL Eddie Gallagher will have his rank reduced and is sentenced to four months of confinement, which he has already served, for posing with the body of a dead Islamic State fighter, the San Diego jury decided Wednesday.
Gallagher's attorney confirmed to Fox News that he will retire from the U.S. Navy when he becomes eligible in about three weeks as he hits his 20 years of service.
The SEAL was found not guilty Tuesday on six of the most serious counts he was facing, including premeditated murder, willfully discharging a firearm to endanger human life, retaliation against members of his platoon for reporting his alleged actions, obstruction of justice and the attempted murders of two noncombatants.
"I feel fine. Its all right, you know? The jury came with a verdict. I trust them," Gallagher told Fox News after his sentencing Wednesday, which stipulates his rank will be reduced to an E6 paygrade, affecting both his pay and his benefits. A jury also sentenced the SEAL to pay $2,697 per month for four months.
Prior to sentencing, Gallaghers defense succeeded in getting the judge to reduce the potential forfeiture to 50 percent, arguing that some of Gallaghers pre-trial confinement was tantamount to punishment based on the fact that he was denied access to a computer and some medical treatment. Even though the jury came back with a 4-month partial forfeiture of pay, it will be cut in half, resulting in 2 months partial forfeiture.

He should wait a few months for the think to blow over so he could quietly get his E-7 back.

4 months confinement already served.....fine, reduction in rank and loss of a huge amount of money.....not fine.

The Isis guy was going to be turned over to the Iraqis who would have tortured him in ways we cant even imagine. Whoever killed him did a mercy and should not be punished.
Dont think badly of the Iraqis, the Isis fighters burn people alive after they have tortured them. Its a world we are not a part of.
Isn’t retirement pay based upon the highest rank one attained while on active duty?
The current retirement system is based off of the “High Three” formula and not the base rate of the rank you hold on the day of your retirement. Most of his pay will be at the E-7 rate so the hit is not to big but if he stays in, each month will lower his retirement pay and it’s probably safe to say that he would not be promoted back to Chief with a court martial in his records. He can appeal his demotion and sort out the pay differences down the road.
If the rules say no posing with corpses, then don’t do it. But I’m just glad he was acquitted on the big stuff, as the idea of people second-guess our boys in a combat zone is a very slippery slope. Civilians will always get caught up in combat situations, particularly when enemies like ISIS use them as human shields, or actually use them for attacks...it should not be up to the brass to punish our boys because of the behavior of ISIS.
