Is there an actual rule in the UCMJ about posing with a corpse?
Evidently there is but what is ironic is that he was posing with the rest of the squad in a group photo and no charges were brought against them.......go figure!
Probably Article 134. That covers conduct that doesnt have its own specific article.
Id like to see the reviewing authority suspend the punishment. Seems way out of proportion to the crime.
The thing about the UCMJ is that there is always an article that applies to your actions if they want to get you, and if they want to really get you, or if they think you might get off on one charge, it will be a bunch of articles. How charges and punishment comes down is arbitrary and capricious, largely at the discretion of the chain of command, but the chain of command is also looking at their own skin in the game.
It's hard to overlook a photo from the defendant's phone doing something clearly mentioned (after Abu ghirab) in at least one predeployment briefing.
The UCMJ has a catch all article they can charge you under if they want to get you for even jaywalking. Military courts and the chain of command that brings charges can be infested by leftists, just as in the civilian courts. Most of the officer corps is left leaning these days, and would have their troops fire on conservatives if given the opportunity. It’s not your dad’s military any longer.
Might be one in the Geneva conventions.
Geneva Convention IV Article 16, second paragraph, of the 1949 Geneva Convention IV provides: As far as military considerations allow, each Party to the conflict shall facilitate the steps taken to protect [the killed] against ill-treatment.
That being said, these are the animals that have dragged American through the streets and hung the remains on bridges.
