SEAL Eddie Gallagher sentenced to reduced rank, partial pay, after being cleared of murder charges

Navy SEAL Eddie Gallagher will be reduced from an E7 to an E6 and will receive a cut to his pay and benefits for posing for a picture with a corpse.

Navy SEAL Eddie Gallagher will have his rank reduced and is sentenced to four months of confinement, which he has already served, for posing with the body of a dead Islamic State fighter, the San Diego jury decided Wednesday.

Gallagher's attorney confirmed to Fox News that he will retire from the U.S. Navy when he becomes eligible in about three weeks as he hits his 20 years of service.

The SEAL was found not guilty Tuesday on six of the most serious counts he was facing, including premeditated murder, willfully discharging a firearm to endanger human life, retaliation against members of his platoon for reporting his alleged actions, obstruction of justice and the attempted murders of two noncombatants.

"I feel fine. It’s all right, you know? The jury came with a verdict. I trust them," Gallagher told Fox News after his sentencing Wednesday, which stipulates his rank will be reduced to an E6 paygrade, affecting both his pay and his benefits. A jury also sentenced the SEAL to pay $2,697 per month for four months.

Prior to sentencing, Gallagher’s defense succeeded in getting the judge to reduce the potential forfeiture to 50 percent, arguing that some of Gallagher’s pre-trial confinement was tantamount to punishment based on the fact that he was denied access to a computer and some medical treatment. Even though the jury came back with a 4-month partial forfeiture of pay, it will be cut in half, resulting in 2 months partial forfeiture.

Yes and it was a sure thing the guy was never going to get out of it alive anyway. We have become so soft, I can’t believe we did that to this good warrior.

Essentially, Article 15 punishment, busted by a grade and sentence reduced to time served.

This was a show trial and a sham, Kabuki theater, there was virtually no “there” there.

But someone in the JAG could make s show of being tough.

This retired Army Officer believes the punishment far exceeds the crime. I can’t help but believe the fix was in from the Obama era Navy brass and they were livid when the jury would not follow the script. They got this minor conviction and maxed out the penalty. Now is the time for President Trump to follow thru and fully pardon this young man. I do agree that books and more await.

Oh, he’ll get his E7 back ASAP. He’s already rated for it. Unless they LoR him he should have it back by this fall. Then go for E-8 for retirement, just to stick it to the PC JAG.

No condoning the posing with a corpse, but according to his lawyer, the entire team that was there that day posed for the same picture as a group and he was the only one charged.....

It sounded like the prosecutor wanted to nail him for some reason and threw everything at him

An unofficial letter of reprimand would have covered the ‘crime” of that photo. Had he been in my unit, I would have told him not to do it again, end of story. But I am not an Obama era officer.

Good point...I didn’t know the details, but yes, I agree, this was REVENGE for the acquittal. Time for Trump to fix this, and while he’s at it, get rid of the stupid rule regarding enemy corpses...if they’re ISIS, they’re FAIR GAME for any treatment.

I would reduce the rank of all the military brass who pushed for his conviction...to private. They did this guy wrong. What incredible a-holes.

.....just wondering.....yes, he has gotten “busted” down to Petty Officer 1st Class, but when he retires, won’t he be retired as a Chief (E-7)....?? but, then again, my ever-feeble memory seems to recall that he would have had to held the rank of CPO for at least 10 years to retire at that rank.... anybody have any insight...?? (ex-Radioman 2nd Class...)
