The New York Times Shows that Joe Biden Has an Open Lane to the Democratic Nomination
National Review ^ | April 9, 2019 | DAVID FRENCH

I go back and forth on Joe Biden’s chances at the Democratic nomination. On the one hand, we’ve seen him run two primary campaigns, and they both ended badly. Moreover, given the hard left turn of the much of the modern Democratic party, he could find himself constantly on the defensive about his long record in Washington. He voted for the Iraq War. His past tough-on-crime past could haunt him. And he’s got that embarrassing sniffing/kissing/hugging habit.

But on the other hand, what if the universal, hard left turn by virtually every other candidate opens up a center-left superhighway to the nomination? Most of the other candidates are vying for the attention and love of the Online Left, but there’s an entire other Democratic party out there — the majority of the party that doesn’t live on social media. Over at the New York Times, Nate Cohn and Kevin Quealy have put together a fascinating interactive piece that separates the Democratic electorate into two large groups, Democrats on social media and Democrats off social media. It begins like this:

Not for now. If he actually declares he’s in the race and does not walk it back (again) one day later, I expect many more people will march forward and have a Biden story to tell. Such accusations are very easy to do, and can be very difficult to undo.

Not a fan of French but this does make some sense. Biden can run as an above the fray sensible elder statesman while the kids have a socialist food fight. He’d be a lock if the kenyan ends up supporting him.

Just like the repubes tried to skew the primaries towards Yeb by stacking the field to take out rival candidates in 206, the demonrats are doing the same thing. This was a tactic at first demonstrated by the demonrats. It was even posted on FR as it was occurring.

The basic idea is to conflate the pool of primary candidates that will take votes away from other candidates so that the one the establishment wants to win will win. So the question becomes which of the demonrat pool are there for this purpose? Who is there to take the votes away from whom?

They say they want Biden in but he hasn’t entered the fray yet. So who in the demoncrat pool is there to take votes away from Sanders?

Does it matter?

13 states and now Oregon is said to join these states in giving their EC votes to the populace winner. This disenfranchises the voters and it will require a SCOTUS decision on whether this is Constitutional since the Constitution does say the states may decide their own elections but the Presidential election is Federal and not a state election. The precedence in favor of giving states the latitude for deciding how their EC votes will go to the popular vote is how previously states have divvied up the EC votes in the past.

A reminder in overturning or making new law is that it can be overturned when the opposite party comes into power. Sometimes it is done without a fight and sometimes not. In this case, it could be a see-saw battle until SCOTUS finally steps in.
