Pretty sure I know where construction would be starting on first day back to work. Then, as the demolibs would do, simply ignore any court "noises" and proceed. US Marshals are looking for something to do.

Liberals are all for eminent domain and forced seizure of private property until it involves curbing illegal immigration, human trafficking and drug smuggling.

I wonder if those three Texas landowners actually live on the land where the wall will go or do they safely live far enough away to avoid illegal alien criminal actions.

The butterfly group is complaining also. At least they own
a little more land than this group with their 15 acres..

Yeah I think I’m good with Trump started ignoring ridiculous court orders that have no basis in law and are just agenda-driven. They will hate him no matter what he does anyway, right?

The building of the wall is going to need the US Military to protect its construction.

When the wall is completed I think it would be good for Trump to have a series of rallies along the breadth of it.

He needs to get that huge bottle of wine he has displayed at his hotels, and take it to the wall during his rally and have Melania do the honors by christening the wall.

"Under our Constitution, built on the principle of separation of powers, a disagreement between the President and Congress about how to spend money does not constitute an emergency authorizing unilateral executive action," the lawsuit read, in part.

The "disagreement between the President and Congress about how to spend money" is not what PDJT based the NE on.

It was the criminal illegal alien border law violators, known terrorists that have been caught, international criminal gang members that have been caught, international drug smuggling cartel members that have been caught.

Most of all the NE is based on all the OTHER criminal illegal alien border law violators, known terrorists, international criminal gang members and drug smuggling cartel members that were NOT caught and are right here in this country continuing to commit crimes, rape, murder and traffic drugs and sex slaves.

That is what "constitutes an emergency authorizing unilateral executive action."

No "wall" challenge can be made until the case is ripe, meaning until Trump ACTUALLY SPENDS DoE MONEY TO BUILD SOME OF THE WALL.

“First lawsuit against Trump wall declaration filed in Washington court”

“Texas Landowners First to Challenge Trump’s National Emergency Plan”

I’m confused.

Just build the wall up to the edge of their property. Theoretically that will funnel illegal border crossers to and through their property, but since they don’t think there’s a problem they shouldn’t object.

Just build the wall everywhere else and see if these folks want to see hundreds go across their properties.....leave their trash along the way and threaten their families.....and if they use their property purposely as a gate way into the US arrest them and put them in jail for at least 5 yrs.

President has both authority and responsibility to defend our borders.
landowners have right to just compensation for their land, either through negotiations or, if necessary, judicially
but ... either way they eventually are compensated, USA has right to take that land

Good, because this being first could supercede the 9th Circuit’s opportunity to review these.

Someone already noted a 60 foot easement is already in place, I don’t know why anyone would be sending these people a letter saying the government is taking their land, it’s already available.

https://www.gao.gov/assets/300/294982.pdf
Footnote 27 on page 21 says:

27 - The land where this fencing was built has been publicly owned since 1907 when President Theodore Roosevelt reserved a 60-foot strip along the international boundary with Mexico for the United States to maintain the area free from obstructions as a protection against the smuggling of goods between the United States and Mexico. In effect, the Roosevelt easement provided the federal government with
a 60-foot border right-of-way on which it could build the fence.

Apparently though, there is still some dispute going over land acquisition, earlier in the PDF I saw text referring to ongoing litigation.

So I don’t know what the deal is, but I haven’t read the whole thing, just scanned over it. At any rate, there is a 60 foot easement already in place from over 100 years ago, similar to what is done on all public roads.
