Maybe that’s it. McCabe admits to Treason, and the hope is it stops there? It’s a head shaker.
This is not treason, because no foreign power is involved. It’s sedition or possibly conspiracy to commit sedition. Brandenburg v. Ohio recognizes broad 1st Amendment rights to seditious speech, but McCabe’s acts may be over the line. If prosecuted, this case would inevitably go to the Supreme Court.
I don't think it's illegal. Lobbying cabinet members to remove the President because you hate him is immoral and unethical. But the 25th amendment is a real thing in the Constitution and they were trying to exploit it to create a legal coup. An invalid one, you can't use it to remove a guy because you don't like him or even because he committed crimes but rather only if he's incapacitated. But they clearly don't care about the law, only the outcome. We saw that with hos they covered up Hillary's obvious crimes.
Surely they counted on Sessions to recuse himself because that's all he ever did with the job but who did they think would be on board I wonder? Kelley? Mattis? Tillerson? Chao?
