There will be no "emergency declaration." Even if it was constitutionally sound it would be a disaster to defend in a court challenge because the situation there has been allowed to fester for two years already under this current president.
Instead, President Trump will construct sections of physical barriers along the border under the provisions of a Federal law that allows the use of military and/or law enforcement resources to construct barriers and install security measures to stop cross-border drug trafficking.
I actually wonder if Nancy Pelosi doesn't want to schedule the State of the Union address because she fears he's going to use that occasion to make this announcement.
