Andrew C. McCarthy: Why Trump is likely to be indicted by Manhattan US Attorney

The major takeaway from the 40-page sentencing memorandum filed by federal prosecutors Friday for Michael Cohen, President Trump’s former personal attorney, is this: The president is very likely to be indicted on a charge of violating federal campaign finance laws.

It has been obvious for some time that President Trump is the principal subject of the investigation still being conducted by the U.S. attorney for the Southern District of New York.

..But when Cohen pleaded guilty in August, prosecutors induced him to make an extraordinary statement in open court: the payments to the women were made “in coordination with and at the direction of” the candidate for federal office – Donald Trump.

...Moreover, campaign finance infractions are often settled by payment of an administrative fine, not turned into felony prosecutions. To be sure, federal prosecutors in New York City have charged them as felonies before – most notably in 2014 against Dinesh D’Souza, whom Trump later pardoned.

In marked contrast, though, when it was discovered that Barack Obama’s 2008 presidential campaign was guilty of violations involving nearly $2 million – an amount that dwarfs the $280,000 in Cohen’s case – the Obama Justice Department decided not to prosecute. Instead, the matter was quietly disposed of by a $375,000 fine by the Federal Election Commission.

It’s long standing DOJ policy that you cannot indict a siting POTUS. It would be pandemonium if you could, injecting the legal system into the political sphere. If this were allowable every POTUS would be facing indictments as threats to their power.

Of course they can break the rules they make. But it’s just a very bad idea. We have Impeachment in the Constitution that is how you deal with these things. And that leaves open the question, do crimes before office even count? The House will say yes. I say no.

if instrux from Trump are on tape, maybe there is a problem. if it is just Cohen’s testimony, a known liar, probably not. i wouldn’t depend on the Edwards situation as precedent - if a certain court/judge is shopped for, who knows? i don’t think it amounts to much - but it kicks up dust. and that is what the Dems want - a duststorm every single day indicating chaos and wrongdoing, whether real or not.

Yes, let’s hear that again:

“Normal people see the law and Constitution as a neutral set of rules.The neo-marxist left view it as a tool/weapon to be used to destroy all opponents and the law/constitution itself.”

And I think there’s something very important to remember. While the left does indeed operate according the the rule quoted above, they present themselves as seeing the law as normal people see it.

If in the public arena we hold them accountable for the way they use law as a weapon, they don’t have a chance.

Lest we forget...it was Mueller who directed this trash to the infamous Southern District of New York.

Let me repeat:

It was MUELLER who directed this trash to the...almost as bad as the Ninth Circus ...INFAMOUS SOUTHERN DISTRICT OF NEW YORK. A district which is notorious for Left activity.
Which is ALL BAD.

When I read that Mueller did that some months ago, I knew exactly what he was doing.

It’s how Mueller was appointed in the first place.


It was never about “Russian Collusion”. Mueller was appointed with the following goals:

1. Get Trump impeached and removed from Office
2. Failing that, find enough about him to make him a one term President (clearing the field for another GOPe candidate, like Ryan, in 2020).
3. Constrain Trump’s Agenda and put him in a box

A lot of this is payback for Trump’s humiliating defeat of Jeb! for the nomination. Ever wonder why the GOPe keeps saying “Let Mueller do his job?” Because they share those goals. And they will try to force Trump not to run in 2020 (so they can nominate Ryan or Pence instead).

Nope. This is political. President Trump will have Impeachment indictment papers drawn up in the House and he will be tried and convicted in the Senate. If the GOP held senate conicts to remove, they are through as a political party.

Question I have, will VP Pence be tried also at the same time? This could be a coup to install 2nd inline Pelosi if they are both removed a the same time.

Indict - yes, but will be reborn out.
Impeach - possible
Convict - The Senate would never convict. Bad Politics, lack of a crime.

The politics for Trump 2020 is what’s at stake, and there is too much on the table to predict anything.
