Chipotle manager Dominique Moran has been offered her job back after it was revealed she was the victim of a race hoax.
Late last week, Moran was abruptly fired from her management job at a St. Paul, MN, Chipotle after a man named Masud Ali tweeted out video that showed her refusing to serve Ali and his four friends, all of whom are black.
In a surprisingly good-natured way, she tells the group, You gotta pay because you never have money when you come in here. A little later in the video, another Chipotle employee seconds that. Were not gonna make food unless you guys actually have money, he says.
For the next five minutes or so the group complains about being stereotyped and taunts the staff.
In his tweet, Ali accused Moran of racism. Can a group of young well established African American get a bite to eat after a long workout session?

Yep. Even employment cases that are actionable and have rock solid violations don’t have large payouts. I was on the receiving end of multiple serious violations and got a very small amount. Even with those violations I think I only got a settlement because the execs at the company were party to a felony (hacked my private gmail account). I have some regrets about taking that settlement, because that company advertises constantly how ethical/good neighbor/upstanding they are... yet I know things that counter that and could have sunk them. Annoys me to see their virtue signalling when I know what a fraud they are.

This time, the target is a food outlet. The video showing a ‘racist’ manager went viral, and was viewed millions of times. Very few voices on social media raised the issue of whether or not we were getting the truth.
Dominique would be wise to lawyer up and not take that job back.

High School is probably a better time to read that book. I always read a few years ahead of my grade, and got into trouble with the teachers because I flew so far ahead.

Are there any of these “hate crimes” that turned out to be true?
I suppose that there must be but ... it seems unusual for them to be true. And amid the proven fakes, there are many other examples of very theatrical, improbable, events, where proper evidence is lacking.
Ping - yes, it is yet another Fake Hate Crime. This one nearly cost a woman her job.

Her cause of action would be for slander, not wrongful termination.
In Florida—barring some kind of formal employment contract which specifies otherwise—an employer has the right to fire an employee for any reason (excluding things like racism, etc.) or for no reason.
Thus, this woman couldn't sue to get her job back in Florida—an employer right with which I fully agree. However, she can sue for defamation of character, and there appears to be convincing evidence on that point—quite sufficient to soundly rebuke Chipotle.
And the damages? They offered her her job back, undoubtedly with any back pay. Theyve publicly admitted she was not wrong. Youve got to prove damage to your reputation.
I dont mean to keep harping on this, but Ive made it my mission to try on this forum to dispel the notion that filing a lawsuit is like winning the lottery. Lawsuits are long, difficult, and expensive. Big corporations have lawyers coming out their ears. Theyre probably being sued in dozens, if not hundreds, of cases right now for various things. I assure you theyre not intimidated in the slightest by the prospect of this woman suing them, for these reasons:
Im not at all certain that she was defamed, but lets say that she was. Its been common law for hundreds of years that youre entitled to nominal damages for injury to your reputation. Typically in the United States that means youre entitled to a buck if you have no other special damages. As I said in my last, her employer has offered to make her whole. General damages is synonymous with pain and suffering and has to bear a relation to the special damages. Thats why you get a million bucks if I crash into you and cripple you for life, and some nominal amount if I careless bump into you and cause you to stumble and bruise your knee.
Punitive damages are tough to get. In California the formulation for a claim for intentional infliction of emotional distress is that the defendants conduct was sufficiently outrageous as to exceed what should be allowed in a civilized society Is that what happened here? Its a pretty high bar. Lets say that it did: The Supreme Court has held that punitive damages
Must bear a ratio not greater than roughly ten times actual damages. She has no actual damages, so theres no foundation for punitive damages.

To clarify: youre entitled AT LEAST to nominal damages where, as here, you have suffered no actual damages

Too bad it can’t be part of the settlement that all those involved with the decision to fire are, in turn, fired with no golden parachutes.
The corporate world needs to start thinking on inquisitions to rid themselves of the SJW infestations.
