A federal judge dismissed charges Tuesday against two doctors and six others involved in the genital mutilation of nine girls at a Detroit clinic, and also declared a US law banning the practice unconstitutional. US District Judge Bernard Friedman dismissed mutilation and conspiracy charges against Dr. Jumana Nagarwala, who performed the surgery, and Dr. Fakhruddin Attar, who allowed his clinic in Livonia, Michigan, to be used for the procedure. The same charges were dismissed against Attar's wife, Farida, and Tahera Shafiq, who assisted in the procedure, as well as four women who tricked their daughters into going to the suburban clinic to undergo the practice for religious purposes. Four of the nine girls are from Michigan; the others are residents of Illinois and Minnesota.

Michigan passed a law a couple months after these people were arrested. So they were too late. This should not be a federal issue.
If ever there was a reason for the feds to step in, this is it.

Male circumcision is (or at least began as) a religious issue and "Congress shall make no law". I have no idea whether female "circumcision" is a Muslim teaching derived from faith but, as barbaric as I view it, I would stand with the judge's interpretation of this not being in the Federal purview.
From what I can tell, the judge is right in this case. Interestingly, his statement about the unconstitutionality of Federal regulation of medical procedures is a powerful statement about the unconstitutionality of ObamaCare, too.

According to the story, the judge ruled that FGM is properly regulated by the states and that the federal law against it is unconstitutional because it infringes on state authority. Michigan has also passed a law against FGM but apparently after these instances occurred. My guess is that the judge was simply looking for a way to get the Muslim doctors off and, being a judicial activist, he grabbed at anything that gave him an excuse.

I respectfully disagree. Today it’s “the feds need to protect possible victims of genital mutilations.” Tomorrow it’s “the feds need to protect possible victims of gun violence.” No thanks.

That is the hard part of conservatism.
Stepping back from your emotions and taking a rational, long-term view of the path that “the government should do something about this outrage (of the moment)” will take.
Is this (FGM) wrong? You bet. Is it the purview of the federal government, and could the approach to cure it at a federal level be misused?

My first reaction was horror, but upon calming down and realizing that the judge was correct...unconstitutional.
Those worried about any gun related decision, please remember that to bear arms IS in the constitution.
There’s another horror happening. I received an email saying the patriot who filmed Planned Parenthood is being charged with 15 counts of crime for doing that.
I hope this gets more attention. This man needs help and I am so stupid that I don’t know how to start a GoFundMe.
