It is very dangerous to equate common sense with the law.
Especially as regards self defense.
And because “reasonable to believe” is subjective and some prosecutors are not reasonable.
In our state, a couple of years ago, a huge black guy...ex pro football player, on a dark rainy night was beating on a residence door yelling and screaming...
And this in a town with a very high violent crime rate.
Sounds scary to me. And the resident of the house thought so and shot him through the door.
Investigation determined that the black guy had a wreck, hit a tree and was trying to get help.
Shooter went to jail because was not in immediate danger of losing his life.
My own guess is that the black guy was hurting enough that he was hysterical.
So an otherwise good man was killed and another guy went to jail just because he did not have the balls to wait a little longer to see what was really going on.
