His seat remains vacant until his replacement is confirmed.
Neil Gorsuch was confirmed to the U.S. Supreme Court in April 2017 and was hearing cases less than TWO WEEKS later.
No offense taken, but that's why I asked. I wasn't sure and couldn't find out for sure if Kennedy's retirement on 7/31/18 meant that his seat would be vacant until a new justice was approved or if he would serve until his replacement was passed. Without Kavanaugh, the court will be composed of eight justices and could have split decisions.
I guess it might be a good idea to look at pending cases that will be heard first and see if there are hidden motives for not approving Kav and ensuring split decisions that would default back to previous ruling.
