Re 2018 Scotus Docket

I do not know what cases are up for consideration but in terms of granting certiorari (Sp?) it takes 4 votes - Scotus
is split 4 - 4 so even if its a week before Judge Kavanaugh is seated if the conservatives want a case they can accept it.

Just my understanding - do not try this at home. ;-)

It’s all a ploy to delay, delay, delay.

On October 10th a very important hearing before the Supreme Court will be held.

QUESTION PRESENTED:
Whether a criminal alien becomes exempt from mandatory detention under 8 U.S.C.
1226(c) if, after the alien is released from criminal custody, the Department of Homeland
Security does not take him into immigration custody immediately.

The Dems want to drag out any confirmation so as to pack cause a tie on this issue.

Obviously the lower court ruled that illegal alien criminals walk free, if not taken into immediate custody. With Sanctuary States and cities fighting ICE, and refusing to hand over illegal aliens, this becomes very important.

If the Supreme Court vote is split (probably will be), the ruling of the lower court would stand, and the Dems fighting ICE and Trump will have succeeded in allowing illegal alien criminals to be immune to mandatory detention under 8 U.S.C. In other words they would go free.

Would Kavanaugh be able to be part of the ruling, if he were not seated by the time the appeal is heard by the Supreme Court?
