This week, President Trump will announce his nominee to replace Justice Anthony Kennedy on the United States Supreme Court. Senate Majority Leader Mitch McConnell has promised to schedule the nominees confirmation hearings for this fall, before the midterm elections.
If and when McConnell carries through on this promise, Senate Democrats should immediately file a federal lawsuit against him for violating the so-called McConnell Rule. (According to this rule, as McConnell himself stated on Feb. 13, 2016, The American people should have a voice in the selection of their next Supreme Court Justice.) The issue whether the McConnell Rule is now binding precedent would not be political (and therefore nonjusticiable) but rather fundamentally legal (and therefore justiciable).

So one senator comes up with a rule, and now the left claims it has the force of law. Right. The left wishes that passing law was that easy.
And it should go all the way up to the Supreme Court. Wait ... uh, nevermind.

A declaration is NOT a law nor even a procedural rule. But it reinforces the left’s belief there is only one branch of government: the Judiciary.
We did, by electing a President who stated a preference for judges who would abide by the Constitution as written, rather than judicial activists.

In 2016 McConnell was saying that a lame duck president should not be naming a SCOTUS replacement so close to an election. That of course has nothing to do with the current scenario. But the prof knows this; he’s just trying to fan the already hot flames. Too bad. Ha!
This law professor does know better, but this is but one example of the disinformation campaign that is going on within the Democrats. This campaign is aimed at their own voters and this stuff is intended to deceive, inflame, and confuse their supporters. They will need a steamer trunk full of excuses when they fail once again.
The American people have already had a say in who’s the next nominees should be. It’s called a Presidential election. Come in, McConnell, speak up!

As the parties exchange power in a constant back-and-forth, of course the party currently holding power makes rules to benefit itself. That’s a time-honored ploy. But it was always understood to be what it is. The left would now like to ratchet it up and pretend these political maneuvering rules have the force of law (the ones which work to their current benefit, of course. If they got their way, and it backfired on them-which of course it must-they’d have a new battle cry).
Each time the leftist idiots ratchet up their stupidity level, it makes you wonder whether they really can be that stupid, or whether it is simply a cynical ploy meant to muddy the waters in an attempt to influence credulous leftist pundits, weak-minded ‘journalists’, and other low-information voters.

And in the 2016 Election, Trump held up 25 Potential Supremes and said these are the people I will nominate to the Supremes! And the People voted for the list!
