If the IRS cannot prosecute the “failure to file” within a timely manner, then the govt should have no standing in further actions.
There should be a statute of limitations along with better efficiency in tracking delinquencies — otherwise, it’s a swamp of Columbo-style investigations chasing down revenue that’s likely off the Fed’s books.
There is no statute of limitations on failure to file as the act of filing triggers the statutory period of examination and assessment.
Why are we taxing them in their independent lands anyway?!
I’m sorry, but 17 years later they want to complain?
Maybe this has been in the works for a few years, but this is idiotic.
1. They are not independent lands.
2. Because the Congress, which explicitly has both the power to tax, and the authority to govern relations with the Indian tribes, said so.
Now whether this law is wise, that is another matter.

A filing may normally trigger examination and assessment, but there’s no guarantee the IRS will handle every situation perfectly. And for those cases that are mishandled, there should be limits.

Yeah, I’m still searching for The Vette6387 Tribe’s “tribal lands.” I’ve narrowed it down to the Waterfront Area in San Francisco. Just as soon as my “claim” is allowed, I’m going to build the biggest casino anyone has ever seen!

Rotsa ruck trying, though. Blood, turnip anybody? Maybe there are some built up riches that paleface can snatch, but most of it is just gone gone gone.
This sounds like the kind of thing that ought to be handled by treaty.
The history of rips has gone in both directions. The last thing we want to gin up is more Indian wars; in this current climate it would be eagerly embraced by our modern lefties.
I’d strongly suggest to Congress that it come up with an amnesty act and forward looking treaty here.
Call it the “Piece of the Indian Action Act” or something like that. In exchange for a retrospective amnesty, politicians get a sin tax on the action.
Except I have problems with sin taxes too, because now there’s a built in incentive to keep the sinners sinning.
A hypothetical evangelical revolution would take the sin quotient way down, however.
Seems they are not being taxed on “their” land value.
They live here and use the highways, utilities, SSA, Medicare, etc., so why shouldn’t they pay income taxes that help to provide those types of things?
