That was a rather embarrassing slip on my part, wasn't it? Rosenstein obviously appointed Mueller. But that still doesn't make his appointment unconstitutional since he has no power to impeach.

Meaning - anything Mueller says will be tied up in court until after Trump leaves office in 2025. This will deflate the impeachment issue if people understand this.

Interesting. I assume that would depend on how one defines "principal officers" as opposed to "inferior officers, and how one defines "significant authority".

Looking at the wording in the Executive Power Clause and in the Appointments Clause, I would think even for inferior officers, the chief executive still has the option to appoint.

Well, de facto, at least, Mueller not only has significant authority, one could say he has more authority then anyone, including the President.

I don’t recall where, but I do remember seeing an analysis of the president‘s tweets and the spelling/ grammatical errors being intentional, to lull his opponents into believing (incorrectly, of course) he’s a bit of a dullard.

Looks like to me that for inferior officers, Congress vests power in the president to delegate authority to appoint, if the president so chooses.

So it's the president who would have to tell Rod Rosenstein to appoint a special council, else the president "alone" could do it.
