Baltimore police commissioner resigns after federal tax charges

The U.S. Attorney's office announced last week that De Sousa "willfully failed to file a federal return for tax years 2013, 2014, and 2015, despite having been a salaried employee of the Baltimore Police Department in each of those years."

If proven, each of three misdemeanor counts carries up to one year in prison and a $25,000 fine. But his ongoing case has the potential to get a whole lot worse for De Sousa: Federal prosecutors have issued grand jury subpoenas to the city's finance and police departments, seeking specifics about his pay, taxes, travel, and second jobs dating back years, according to a Tuesday report by The Baltimore Sun.

De Sousa himself could not immediately be reached Tuesday. His attorney, Steven Silverman, said he did not wish to comment. Last week, Silverman said federal prosecutors didn't give his client a chance to explain himself or file late returns before bringing criminal charges.

I’m guessing the Feds are really going after the city, and De Sousa is the symptom.

Its their ignoring $5-10mm-plus for years that bothers me. Yet a taxpayer can owe a few thousand and they send a SWAT team after him and his family, and use a sock full of quarters to beat him into a confession. His home, job, savings and family are destroyed, and he’ living in a refrigerator crate in a vacant lot somewhere. The Dept of INJustice & IRS strike again.

There is a failure to file penalty calculated on taxes owed. The penalty is nothing if no taxes are owed.

Or that he was so special that Baltimore wasn’t going to send in his W-2s to the IRS, or alternatively, that the IRS wasn’t going to wonder why they were getting all of his W-2s but no returns?

It is technically illegal not to file but if you owe nothing it will usually not be prosecuted.

Nonsense.

Fact: If you have no tax liability for any given year it is entirely legal not to file a return. You cannot be penalized or prosecuted for failing to file a return you were not required to file.

One might file a return for a year during which you had no taxable income because you had loss carry-forwards, or for many other reasons.

Typical FR tax and financial illiteracy. Do NOT seek tax advice on this site. Or any other.

Ah, no, that's not how it works.

30 years ago, I owed over 500K and I paid a few hundred bucks monthly under their agreed-upon deal until their 10-year collection period expired. They were quite civil about it. They knew their lien had expired and their collection period had expired and that was that.

I'm sorry that you really don't know anything about IRS collections or procedures.

Louis Lerner should probably be in prison for what she and her underlings did to Tea Party 401(c)3 applicants, but that's a separate issue. We taxpayers got to pay 3.5 mill for her abuses.

If you could view his personal life you’d probably discover that he no longer lives in a clean house, that he no longer maintains his car and that he most probably smells bad. He may be depressed or possibly a stroke victim. I have seen people disintegrate like this. Somehow, they don’t get fired, but keep on coming to work. Everybody who works with them knows there’s a problem. We don’t learn how big the problem is until something like this happens.

The only ones who are not required to file are those whose taxable income is below a certain level.

If your income is above that level you are required to file whether you owe or not.

You are correct about one thing tho. Do not take your ideas from an internet discussion.

If you make sure that you are due a refund every year you can get away with not filing for several years. You had better be certain though.

If you consider the fact that the government lies, cheats and steals as a matter of policy then it may be a little easier to understand. I’m sure you make great efforts to be an honest person but in reality it is not actually possible to consistently abide by the law in a nation where there are many specialties within the legal profession simply because it is beyond the ability of even legal professionals to keep up with all the changes in laws and regulations within even one specialized area. There are many conflicting opinions on the meaning of the sixteenth amendment itself. Right and wrong and legal and illegal are two entirely different matters.

I find it despicable that a government which makes zero attempt to manage expenditures in a sensible manner, not to mention operating under “continuing resolution” for lack of even a budget still has the gall to go after any individual for not filing an income tax return. Any private business that operates in such an irresponsible manner as the federal government generally goes out of business unless fortunate enough to have criminal friends in government to bail the business out. We imprison a very high percentage of the population while many of those who should be in the most secure prisons are actually running the government.

I do believe that president Trump is working to change the situation but it is important for those of us who recognize just how twisted and criminal our government has become to speak out against it.

Agreed and it is chaos.

People generally agreed on what was right and wrong and people used to try to be honest or at least pretend to be honest. Even the government tried to be fair for the most part.

It probably has to do with the fact that attitudes have changed. It is no longer what “you can do for your country” and fellow Americans and has now become “how can I scam the system so that I can get ‘my share’ or more free stuff” and screw fellow Americans in the process. I know this is a fact — I have first hand experiences.

People both, Democrats and Republicans, had pride and respect for each other. This is no longer true.

I will continue to be honest because it is the right thing to do and because of my Faith.

adding that his brother was taking care of his parents, who had Alzheimer’s, during the period when he didn’t file his taxes........Ahhhh! Alzheimer’s is contagious. Never Knewed it. BTW: Where was the brother?
