It isn’t, until the perp decides to use those those materials to compel behavior. Then it becomes attempted extortion/blackmail.
Attempted extortion/blackmail is a criminal act regardless of the views or intellect of the intended victim, regardless of whether the victim accepts or rejects the attempt. It is not dependent on the victim’s intent, but the perp’s.
If he had to collect such information at the outset to hold over people’s heads, then his intent is clear before the first victim is even chosen. Obviously at the point the victim begins to fear the use of said materials is the point where the activity crossed the line from “attempted” to “committed.”
If they require a person to hold another down then obviously it’s not “voluntary”... regardless of how gullible they were to take whatever bait was originally offered to lure them in, or what they voluntarily did up to that point.
You don’t lose your right to say “no” just because you’re dumb as a box of rocks... but being dumb as a box of rocks won’t protect your rights from being violated by criminals, either.
Again, that he used the precaution of choosing one person to restrain another is proof of his criminal intent.
