The Trump administration announced Monday night it will be reinstating a citizenship question to the decennial census in 2020, prompting threats of lawsuits by prominent Democrats.
Former Obama Attorney General Eric Holder and California Attorney General Xavier Becerra separately announced they will file respective lawsuits to stop the citizenship question from being asked during the census.
Holders statement called the move by the Trump administration a direct attack on our representative democracy.
Becerra called the decision, illegal.
The Commerce Department, which oversees the census, issued a statement announcing the decision:
Today, the U.S. Department of Commerce announced that a question on citizenship status will be reinstated to the 2020 decennial census questionnaire to help enforce the Voting Rights Act (VRA). Secretary Rosss decision follows a request by the Department of Justice (DOJ) to add a question on citizenship status to the 2020 decennial census.

The citizenship question will be the same as the one that is asked on the yearly American Community Survey (ACS). Citizenship questions have also been included on prior decennial censuses. Between 1820 and 1950, almost every decennial census asked a question on citizenship in some form. Today, surveys of sample populations, such as the Current Population Survey and the ACS, continue to ask a question on citizenship.

I guess it comes down to how you define a “free Person”. DJT should issue an EO that describes a free person as a legal citizen.

They may not be allowed to vote legally, but they’re not here legally, either are they? Do you really think they’re not voting, and in substantial numbers? In California, especially?
CA has a law that limits the # of voters to a polling station (Memory is around 800 but haven’t checked the law lately). Thus, you have folks using their garages as polling places. Who controls registration? In a lot of those communities, there’s a wink and a nod to those who wish to register to vote illegally. They can lie and the registrar will swear to it when they show their “drivers license.”

The citizen question was on the census forms for 130 years, and as far as I know, no one has ever filed a lawsuit to have it removed. It was done arbitrarily.
Agree 100%, although in this topsy turvy world where nobody is held to account...I shudder to think.
& Trump Admin already saw this coming. The Commerce Dept is basically saying they need the citizenship question to help enforce the Voting Rights Act..the same Voting Rights Act that the RATs are always squealing about and racist GOP trying to undermine/eliminate it..etc..

In Holder’s application to be admitted pro hac vice he will have to disclose his contempt citation in the House of Representatives. That alone should disqualify him.
Eric Holder does not have standing to file such a lawsuit.

Oh, they ARE counted for the purpose of representation all right, both in Congress and in the Electoral College.
That pisses me off and I suspect it would piss off just about everyone who actually understood that fact, but few do.

What standing does a state have to sue over questions on a federal census?
What is the standard regarding frivolous or unfounded lawsuits, anyway?
