Why the heck did President Trump announce this before he does it? Now a rogue judge can stop it before the building starts.
It might not matter that Trump announced this as the spending bill worked its way forward. For example, we know his campaign statements were supposedly enough to stop him from exerting his Presidential power in area of national security.
I would not be surprised if a leftist judge is waiting in the wings waiting to halt the building of the wall either on environmental grounds, or more more likely that it discriminates against an entire class of people who have connection to regions south of the border.
There’s no way to start anything on this scale without announcing it ahead of time. Judges will try to stop this, as they try to stop everything, but they probably won’t succeed.

Section 2 – Authorization For Use of United States Armed Forces
(a) IN GENERAL- That the President is authorized to use all necessary and appropriate force against those nations, organizations, or persons he determines planned, authorized, committed, or aided the terrorist attacks that occurred on September 11, 2001, or harbored such organizations or persons, in order to prevent any future acts of international terrorism against the United States by such nations, organizations or persons.
This authorization has NEVER been rescinded.
Business Insider has reported that the AUMF has been used to allow military action in Afghanistan, the Philippines, Georgia, Yemen, Djibouti, Kenya, Ethiopia, Eritrea, Iraq, and Somalia.
