The McLennan County District Attorney's Office dismissed the case against Twin Peaks shootout defendant Cody Ledbetter on Monday, four days before a jury panel in his case was supposed to report to court.
The dismissal, signed by prosecutor Michael Jarrett, says that while probable cause remains in the case, the state is focusing on more culpable defendants in the Twin Peaks shootout, which left nine dead and dozens injured.
Ledbetter, a 28-year-old diesel mechanic, and his attorney, Paul Looney, of Houston, eagerly snatched up the April 2 trial date that had been reserved for the retrial of Jacob Carrizal, president of the Dallas Bandidos chapter, whose trial in November ended in mistrial.
Carrizal, who has a new attorney, asked the court last month for more time for his attorney to prepare.
Ledbetter, who has said he has been ready to go to trial for almost three years because he didn't commit a crime, witnessed his stepfather, Daniel Boyett, get shot during the May 2015 brawl between two rival biker groups. Boyett died from his wounds.
"It is just time to go in and lay the cards on the table and let the jury exonerate this man," Looney said last month. "He has been innocent and on bond for three years. That is a torture that no innocent person should have to go through. It is time for it to stop, and we are finally in front of a group of people who can finally make it stop."
Looney filed a motion to disqualify McLennan County District Attorney Abel Reyna in October after it was discovered that the DA's office released videos from Ledbetter's cellphone that showed Ledbetter and his wife having sex. The videos were sent to more than 125 attorneys as part of the massive Twin Peaks discovery process.

Many held on charges were never gang members.
“Imagine that! “Focusing” on the people who actually shot other people. What a radical concept... “
I hadn’t heard that they were going to start trying the cops who shot people! I think it’s long past time for all the ballistics data to be made public. Just how many of the dead had .223 bullets in their bodies?
Surprised at the dismissal, but doubt the rest of the Cossack gang will be so lucky.
True.
They already decided to let the police who fired deadly shots that day walk on any charges.
"Those weasel words are nonsense. District Attorney Abel Reyna and his troupe of dancing dogs including Jarrett never had a viable case against Ledcetter. If they had, they would have had him on trial in something less than 700 or 800 days ago.
Looney has always been a thorn in the side of the illegal and corrupt prosecution that began immediately after the mass murder on May 17, 2015. Two weeks after nine men died and 177 witnesses were held on $1 million bonds, Looney alleged that “an attorney representing at least one of the detainees had been offered…bond reductions” in exchange for signing a statement conceding that local police “had the right to arrest the inmate and that he/she will not file a lawsuit against McLennan County and/or the City of Waco.” The unsubstantiated allegation that “probable cause for the Defendant’s arrest and prosecution remains” is just the latest iteration of various rhetorical spells by which prosecutors have sought to protect themselves from the consequences of their crimes."

Just how many of the dead had .223 bullets {marks of FBI agent Lon Horiuchi of 1992 Ruby Ridge} in their bodies?
Translation: "We couldn't prove our case because we've been fishing and we are now getting too much attention - if we tried this guy, we'd lose and that would hurt our chances of railroading others."
“IB the biker hater”
Gangsters here say that per rule #13.
