Maybe, but here's the way I kinda see this.

There are some guys robbing a bank. Someone outside the bank sees cop cars approaching, lights flashing. The person outside the bank makes a phone call to one of the robbers and tells him to get out cuz the cops are coming. Did the guy outside the bank break any laws?

IMO, the guy making the call became an accessory to the crime. But the crime only existed from the time the perp walked into the bank and initiated the robbery.

The Mex aliens were already illegal and are being serviced by the city/county gov. The Mayor is more of a conspirator than an accessory.

I say arrest him for being an accessory and let the courts settle it.

Same for the Oakland mayor.
