Does this student have a history of threats or being a predatory, unstable weirdo, or is this a case of the threat being his use of the 1st amendment to dare speak about the 2nd.
Well I can see why "administrators" would take a zero-tolerance stance.
The school administration demographic is a lot like law enforcement... it is comprised of a certain % of those who derive deep satisfaction through lording over others.

arrested for violating what? The First Amendment right of free speech? The Second Amendment right to keep and bear arms? the Fifth/Fourteenth Amendments right to Due Process of Law?

If there were precursors, like an argument, or alluding to a school, maybe.
But we are on the edge of a “no tolerance” policy like we’ve never seen.

As for the suit, it looks to me like everyone involved in it, from the call to the arrest to the filing of charges is going to be guilty of violating this kid’s civil rights under color of authority. That’s EXACTLY what Title 42, Section 1983 is all about - they are PERSONALLY liable.
Seems to me that the kid doesn’t need to go to college except to learn how to put a couple of million bucks to good use.

It wasn’t even necessarily about arresting Cruz for saying what he said. It was about watching him and catching him in the act of trying to carry out the attack. Would have taken a little effort and self-discipline on the part of those watching him, and there was enough evidence and testimony for suspicion to justify the expense. They might have even caught him with some weed and taken the weapons away.
Hindsight? The young folks involved said that they knew of a likely threat. Young people and their parents should report such threats for interview and investigation. Police should follow through.
And bring back the asylums and reform farms. Too many severely psychopathic and psychotic people on their own and getting in trouble.
Outrageous knee-jerk reaction. If they want to stop school shootings all they have to do is allow, on a voluntary basis, qualified adult school personnel to carry concealed weapons. Follow that with a public announcement of the change in policy.
