A Virginia-based federal court of appeals on Thursday ruled the latest version of President Trump’s travel ban unconstitutional citing that it unlawfully discriminates against Muslims.
In a 9-4 decision, a majority of the judges on the Fourth Circuit Court of Appeals said it examined official statements from Trump and other executive branch officials, along with the proclamation itself, and found it “unconstitutionally tainted with animus toward Islam.”
The court is the second federal appeals court to rule against the ban.
The most recent iteration of the ban bars people from eight countries — six of which are predominantly Muslim — from coming to the U.S.
The Supreme Court had decided in December that it would allow the latest travel ban to take effect while litigation ran its course.
In late December, a panel of the 9th Circuit Court of Appeals ruled against the third iteration of Trump's travel ban, saying it goes against federal law.
The Supreme Court last month agreed to review the legality of Trump's travel ban and is expected in April to hear arguments regarding the order.

They (USSC) did say Trump’s order could remain in effect until the case works it’s way thru the courts. By staying the lower court injunction the USSC has signaled the likelihood of the Administration prevailing.
Is the ‘extreme vetting’ available yet? This travel ban was supposed to be the short-term stop gap until that was put in place... which would render the entire argument moot.
And another asinine lower court decision is off to SCOTUS to be properly overturned.
Where does it say in the constitution that foreigners have a right to come to this country?
They should make the judges live with the incoming immigrants and you will see how quickly their attitudes change.
There is no ‘rule of law’ when the judiciary itself is lawless.
Our judicial system is rife with Soros’ people.
The courts are simply out of control. Arrogant and lawless.
I thought SCOTUS ruled on this already.
How can an appeals court overrule SCOTUS?
Solution: Ban EVERYONE. Like the DI in FULL METAL JACKET. There is no prejudices. Then name off every religion in existence including witchcraft and satanism.
Does that mean enabling Mexican illegals endorses Catholicism?
Any appeals court that would do this would also declare the 2nd Amendment unconstitutional. It is just a matter of time.
Count on it.
How about “animus against SOURCES OF TERRORISTS”????
DACA was Unconstitutional. Where were these pleaders when this went down.
It’s too bad there isn’t some kind of financial penalty for getting overturned by the supreme court. It’s going to take about 3-4 presidential terms to flush out most of these #resistance judges.

HOW do these FACTS prove any animus to Islam?
