I’m not a lawyer, but I suspect any such legal protection would probably hold even if they were divorced.

My first thought exactly!
Spousal privilege has new meaning with the revelation that Huma had Secret e-mail backed up on his computer. Unless the Obama Justice department immunized her (and I’m not putting it past them) - she is facing some difficulty, and the ability to make him unable to testify about their spousal communications could make her prosecution harder.
