Michael Flynn FBI plea deal opens pathway to Donald Trump: Judge Napolitano

....The FBI’s evidence against the former general could put him in prison for 60 years, but making a plea deal could reduce his sentence to six to twelve months, Judge Andrew Napolitano, Fox News senior judicial analyst, told FOX Business’ Stuart Varney.

Napolitano said Flynn may have shortened his sentence by offering federal prosecutors some kind of link to Trump or someone within the administration.

“Sometime between Monday and today, they reduced that deal to writing. [Flynn] has real evidence that we can really use to prosecute someone, perhaps the president, we don’t know, and in order to lock the general in they got him to plead guilty this morning,” Napolitano said on “Varney & Co.”

Anyone American citizen can talk to any foreigner, all they want, perfectly legal.

Except when that foreigner represents and negotiates on behalf of a foreign government, and what you agree to is contrary to the stated government policy of the USA.

That’s illegal because it subverts our government, even if it’s done one minute before Obama is out of office. That’s what happened.

Have you ever actually read the logan act? It doesn’t say, “You can’t talk to a foreign power.”

There are very specific elements:

You have to have be acting “without authority of the United States” and with specific “intent to influence” the foreign government or agent thereof,

“in relation to any disputes or controversies with the United States” OR “to defeat the measures of the United States.”

Cooperation with ISIS isn’t an attempt to defeat any measures of the United States, and there wasn’t any “dispute or controversies.”

And you are just flat out wrong about “only the Supreme Court” can throw out a statute. Any federal court can enjoin the enforceability of or dismiss an indictment based on an unconstitutional statute.

The void-for-vagueness doctrine IS a Supreme Court doctrine, and that is the precise problem with the act as written, and that’s what the Court in the Waldron case pointed out.

Your precious Logan Act is unconstitutional as written, because “defeat” and “measures” aren’t enough to put anyone on notice as to what those terms mean in accordance with the Sixth Amendment.

So go cry elsewhere.

How the hell did we get here? Well, it was predictable. We are here because Robert Mueller is, was and will continue to be the Deep State’s agent to affect a coup d’etat.

Unfortunately it was only obvious to some of us. Another group here is still convinced Mueller is working for Trump and actually targeting Hillary, even after today, believe it or not.

This is all such a farce. Hillary has broken about 100 laws, placed our national security at risk, was laundering money, doing pay-to-play big time internationally and within the US, has been lying her whole life, did the bimbo eruptions unit in the basement of the White House, stole FBI files to get dirt on everyone, and too many other scandals to mention here and now Trump is in trouble because Flynn lied to the FBI. So sick of the double standard.

Fire Mueller and get several Special Counsels to get the evidence on Hillary, all her cronies, Obama and all his cronies, weaponizing the IC, the Unmasking and again, too many crimes, scandals, sedition and treason to mention here. Real Crimes!

In addition to the Act violating the Sixth Amendment, most scholarship on the topic also believes that it violates the First Amendment as well.

The law doesn’t define “disputes or controversies” between
the foreign country and the U.S., nor does it say what it means to “defeat the measures of the U.S.”

Remember, the Federalist Congress that passed the Logan Act in 1799 had also passed the Sedition Act of 1798. That was the law made it a crime to impede any act of government or prevent a government officer from performing his duty. It was used to attack newspaper publishers who were against the Federalist position.

The Sedition Act is the law that is used as an illustration of laws that violate of the First Amendment.

The last time the Logan Act nonsense was drummed up, was when libtards were trying to say that 47 members of Congress violated it by sending a letter to Iran during the Obama Administration. It’s a sham.

If Trump promised Putin something for help getting elected (quid-pro-quo, ignoring US interests for Trump’s personal success, etc), let’s get it over and move on to President Pence. I’m all for impeachment if it happened.

But we’re 15 or 16 months into multiple investigations (FBI, congress, Mueller). We need to either move into impeachment now, or stop hoping that someone who lied to the FBI may have some information that the FBI was not able to find in a year and a half with at best questionably legal surveillance that may eventually lead to some other information that we have an illegitimate president.

If our FBI REALLY, REALLY, REALLY sucks and cannot tell that the US president is a Russian agent after a year and a half they need to be shut down. If they are competent at any level, we need to move on if this is all they have on the Trump campaign. They cannot claim that both 1) they are competent and 2) investigations need to continue.

Yes, the Logan Act is what they jailed Jane Fonda for when she smilingly embraced the NVA antiaircraft guns used to shoot down American aircraft. She spent a lot of time in prison, didn’t she??
