I don't think it would be legal anywhere in the US to shoot someone who isn't an immediate danger to you or someone else. Hero Willeford shot an active shooter at the scene of the crime.
And if it was true that Kelley had reloaded following the car crash, IMO, he (Willeford) would have had the right to shoot him again at that point.

Anyway, even if Kelly hadn’t reloaded after the chase. They could have shot him down simply to apprehend him. He has just murdered an entire church. Its easily explainable that he wasn’t going to stop until he hurt more people.
And good luck finding a DA or jury to go after him. And by the way, in the bizarre scenario where you did, Governor Abbot would pardon him.
But what about possible Federal charges, President Trump, pardon again.
All he is gonna get in Texas is a medal.
