He was a fleeing felon. Texas gives more latitude but there is a limit on lethal force.
If kelley had a believed to be hostage that would change things up as it would be kidnapping type thing
Imagine the next election for a DA whose office charged one or both of these citizens who chased this guy.

There is NO limit in Texas on killing a killer. There is no jury in the state that would convict this civilian hero who used his gun to kill a killer.
Too bad several members of this church had their weapons in their cars. That is a mistake rural church members should not make in the future. That is why rural schools allow legal gun carriers on their staff to bring them onto school premises. The sheriff in some counties is half an hour away from those schools.
The fleeing felon ‘rule’ is that a felon can be dealt lethal force if they’ve committed a felony such as murder and still pose a threat to the community. He was still armed ergo the defender is clear in his judicious use of force.
Any DA that even tries to go after him would be strung up by their nuts.
Dream on. This isn’t the DC brie and wine-sip circuit. There are zero issues with shooting Kelley. There will be no cases arising out of it in Texas. You need to get out more.
