Illegal immigrant teen in Texas has right to abortion access, judge rules

A federal judge ruled Wednesday that the federal government must grant a pregnant 17-year-old illegal immigrant access to publicly funded abortion services in Texas.

U.S. District Court Judge Tanya Chutkan ordered the authorities to transport the minor or allow her to be transported by someone else to the abortion clinic “promptly and without delay."

The lawsuit was brought by the American Civil Liberties Union (ACLU), centering around the minor called “Doe,” and whether illegal minors have a right to publicly funded health services, including abortions, in the U.S.

Last week, Texas State Attorney General Ken Paxton came out in opposition to the legal challenge, saying Texas should not become “a sanctuary state for abortions.” “No federal court has ever declared that unlawfully present aliens with no substantial ties to this country have a constitutional right to abortion on demand,” he said in an official statement, citing the woman’s case.

The ACLU, meanwhile, argued in court that the Trump administration was forcing the pregnant woman to continue with the pregnancy against her wishes. She is believed to be around 15 weeks pregnant and in Texas a pregnancy can be terminated only before 20 weeks, the Texas Tribune reported.

"The Trump administration's action is shocking. A young woman is essentially being held hostage and forced by federal officials to continue a pregnancy against her will," ACLU attorney Brigitte Amiri told the Austin Chronicle just before the ruling.

U.S. Deputy Assistant Attorney General Scott Stewart countered the group, saying the minor is free to return to the country of origin and get an abortion there, adding that “the government is entitled to favor childbirth” and under no responsibility to encourage abortions.

ACLU push case using moron illegal to try to push the next cause for them: free on demand health care for illegals.

Recall Mr. Soetoro said no illegals would be on his health insurance program.

This is the way they get them on to the American taxpayer’s back.

Yes, ironically...a one way ticket back to her homeland. At least, according to those that say foreigners here unlawfully are entitled to everything.

Disturbing precedent here.

As a citizen of another country, is she subject to her country's laws when she is here? If abortion is illegal there, why should she have a right to one here? If she had one here, could she be prosecuted if she returned to her country of origin? Would the US gov't be charged with aiding in the commission of a felony?

Can Saudis drink alcohol in the US? How about various other issues like polygamy or the age of consent?

There's another issue here that's much easier to decide - not whether she can have an abortion, but who must pay for it. That one's obvious.

I thought Congress outlawed the use of government funds for abortions. If so, what Constitutional right does this liberal,Leftist judge have to order such expenditures? Guess they don’t teach judges the constitution any more, esp those from Jamaica.

The DC Circuit issued a stay overruling the lower court’s decision that US tax payers must pay for this illegal to kill her baby.
She has a choice to go back to her country or to find a sponsor who will pay for the baby’s murder. Will anyone be surprised when the hammer of God’s judgment falls on this country?
