Officer placed on leave as DA launches criminal investigation into arrest of Utah nurse

Salt Lake City Mayor Jackie Biskupski announced that as a result of the criminal investigation being launched by the Salt Lake County District Attorney, Detective Jeff Payne will be placed on full administrative leave with pay.

Later Friday night, police stated two employees are on administrative leave. It was not immediately clear who the second employee is.

Unconscious, on a ventilator and badly burned, no doubt he was loaded up with a bunch of medications that may or may not be readily identifiable from illegal or non-prescribed in a late tox report. The only one that would be of any use to PD would be the draw they took 2 minutes after he rolled through the ER door.

DOT regulations cannot supersede the constitution.

The hospital’s obligation to sustain life supersedes DOT “regulations.” Police cannot make medical decisions.

I am a realist. Payne tried to bully up the ladder instead of down. This is one of the reasons he should be fired because it shows an astonishing lack of both self-control and situational awareness.

I find it interesting that the nurse and her lawyer sat on those videos for a month. It went viral at warp speed.

Exactly. And the nursing profession is going to make an example of this cop to emphasize yet again to the goon squad that You Do NOT Lay Hands On Medical Professionals.

They got a dog in this fight and it’s a big one.

The preservation of life comes first; that was the responsibility of the nurse, and the hospital for which she worked. The patient was in their custody, and remains so until a qualified medical professional releases him.

The cop gave an unlawful order to protect his own culpability from his unlawful and extremely ill advised pursuit of a suspect.

You’re a pompous idiot, and you owe 6 people an apology.

I would think that is obvious.

The police, when asserting lesser prerogatives than protecting life are without pressing obligation or authority.

Police are not constitutional officers; they are created by statute, not by any ‘higher’ order.

I heard an attorney on TV explain that your blood is personal property, just like your car.
If a cop asked you to go steal your neighbors car so he could search it. Would you do it? I think not.
That’s what he was demanding of this nurse.

I agree, something was up. It is a university hospital, and the university police were there doing nothing.

I also heard her interviewed. She said the hospital had positive meetings and cooperation with the city, but negative meetings with the university police and university security.
She said that was one of the main reasons that she went public.

You’re angry. That should be enough to show you that you are afraid of the truth. I’m not angry. Its sad that so few people understand the Constitution. But, in a way it is also funny.

We had a whining bitchy nurse who wanted to assert herself and she infuriated the cop who acted badly on the video. She had no right to refuse to comply. He should had just charged her with obstruction and forgot about the blood sample. But, things got out of hand. Now he is going to get fired. His mistake, his problem.

I’m pretty sure all the overheated posters with personal insults above are folks who are also scared of cops, hate the cops, scared of authority. Otherwise, why would they be so excited?

Your characterization of the nurse as whiny and bitchy is inaccurate, imo. She seemed quite calm while explaining the policy which she also printed out for him.

She had a professional duty (not a right) to not comply even if it conflicted with the orders of a police officer because his orders contravened the written policy agreement of his own agency. Because both he and his supervisor both refused to listen past the word “policy” they never figured out that they were being told it was a joint policy agreement.
