Could be. Kinda like searching the home of the woman murdered a couple of months ago by a somali muslim cop.
“If he cannot state the source for his authority hes full of crap...................”
How about this:
“[Officer] Payne ... was advised by Lt. James Tracy, the watch commander on duty that night, to arrest Wubbels for interfering with a police investigation if she refused to let him get the sample, according to his report.”
Legally, an illegal blood draw should have no bearing on his standing. Logically, we know it will.
She did keep her cool up to the point that the cop grabed her. This arrest is going to get tossed. She’ll have no arrest record. She held her ground. We need more like her.
They are BOTH stupid, and in deep crap.....................
“Hardly. Patient confidentiality is a very real issue. HIPAA and the 4th Amendment are in play here.
The unconscious person in her hospital was the victim of a head-on collision caused by a perp (who died in this same collision) the Utah police were chasing.
There is no cause for this victim’s blood to be drawn.”
On the contrary, federal law requires a blood test be taken when a commercial truck driver is involved in a fatal collision regardless of who is at fault.
Big tough men should be utterly ashamed. They deserve a punch in the face.
Torres was killed after crossing into the lane of Gray.

They managed to turn that whole hospital into a den of cop hate. Good job a-holes. And all to hopefully try to find dirt on the guy they hospitalized with their deadly chase of someone else.
> Perhaps if she kept her cool and didnt resort to screaming and being dragged... <
That’s actually a fair comment. I don’t agree with it, but it’s a fair comment.
One thing to consider, however, is the nature of the situation. The nurse and the cop were having a calm conversation. No heated words, no raising of voices. No hint of a confrontation. Then all of a sudden the cop exploded and grabbed the nurse.
I gotta tell you, if I’m having a calm conversation with a cop, and then all of a sudden he grabs me, I’m going to react in a primal way. I think anybody would.
Now, if the cop had said from the beginning, “I’m here to arrest you”...well, that’s different. I would expect to be cuffed. I wouldn’t struggle.
Agree with those who say this is why cops are not helping their own image/situation, even if this sort of incident is very much a minority.
With all that cops have to deal with, from being on the front lines and dealing with the fringes of society, to being targeted and blamed for things out of their control, it’s not hard to understand why you’d have a chip on your shoulder as well as having your head on a swivel, and need a certain level of confidence/bravado in order to deal with it all. But I still believe that they need to do a lot of psychological screening for law enforcement. It takes a special kind of person to deal with the crap that they do and not want to take short-cuts and not to completely resent the people you are dealing with and trample their rights. It’s a very hard thing to do. I don’t think I could do it.

You don't seem to understand that the nurse would have been held responsible for all of this if she had followed Office Jackboot's illegal order.
Perhaps if Office Jackboot had kept his cool and not been so determined to violate both the law and rights of his fellow officer this could have been avoided.
“They managed to turn that whole hospital into a den of cop hate. Good job a-holes. “
They????
It was ONE cop,one.
.
> She held her ground. We need more like her [the nurse]. <
Yes, absolutely. It is not a stretch to call her actions here patriotic. She stood up for the Constitutional rights of another citizen.
Thank-you. That was the best laugh of the morning.
There were more then one cop
Maybe, if you’re admitted to a hospital while unconscious, and they remove your gonads because you don’t need them...you’ll be just as understanding.
> federal law requires a blood test be taken when a commercial truck driver is involved in a fatal collision regardless of who is at fault <
But that’s something a truck driver knows going into the job. It’s implied consent. For everyone else, the Fourth Amendment applies.
