For murder, the prosecutor is going to have a hard time proving malicious intent, what the guy was thinking at the time.

It would not shock me if the prosecutor filed a murder charge specifically to make sure the guy got off at the end of the day. It would be much easier to prove a vehicular homicide charge in a case like this.
