“This is not a pretty picture.”
You’re right, it demonstrates an appalling ignorance of the law and the Constitution.
A President cannot be charged with a crime by ANY entity besides the House of Representatives. And the ONLY trial he would have to endure is on the floor of the US Senate.
Mueller cannot charge Trump with a crime and cannot prosecute him.
Mueller is all about optics and BS. It’s not going to work.
Mueller clearly knows he cannot indict President Trump.....
He intends to go after the Trump children......
Q. Would you resign to protect your children? Of course, he could pardon them....
Then refer any manufactured evidence on President Trump to the House of non-Representatives.....
Humm....well, maybe. Actually I have a JD and I do not feel I’m ignorant of Constitutional law. Maybe you’re right. Here’s how we find out. Mueller indicts Trump for a) obstructing justice for firing Comey or trying to influence the Flynn investigation and b) some financial crime not related to Russia.
As for a), these acts are part of Trump’s official duties - like granting a pardon. Crime b) is not.
Trump moves to dismiss the indictment on the grounds that a) are part of his duties, therefore not a crime. Crime b) should be dismissed on the grounds you suggest.
The Obama appointed trial judge will deny Trump’s motion. The Obama dominated DC circuit will deny his appeal. Trump must appeal to the Supreme Court to get an answer.
Trump will probably be cleared, but how long will it take? It would only be a prelude to impeachment should the Dems take the House.
Which has why I said it’s not a pretty picture.
