Minnesota Bureau of Criminal Apprehension investigators were granted permission to search Justine Damond's home hours after she was shot and killed by a Minneapolis police officer, according to court records.
A criminal law expert can't understand why.
"When I read that search warrant, I really cannot find probable cause to search her home," he continued. According to court documents, investigators applied for the warrant on the following grounds: The property or things above-described was used as a means of committing a crime
The possession of the property or things above-described constitutes a crime.
The property or things above-described is in the possession of a person with intent to use such property as a means of committing a crime, or the property or things so intended to be used are in the possession of another to whom they have been delivered for the purpose of concealing them or preventing their being discovered.
The property or things above-described constitutes evidence which tends to show a crime has been committed, or tends to show that a particular person has committed a crime.
Asked if that means the BCA considers Damond to be a suspect, spokesperson Jill Oliveira replied via email:
"No, an individual involved in the incident."
Daly, who said he has served as a visiting professor at the University of Queensland in Damond's native Australia, believes concerned members of the public in both countries will be outraged by the BCA's request to search the home.
"It's going to cause an international incident," he said. "I mean the prime minister of Australia already talked about this case on international television, and I think Australians are going to go berserk if they think the focus is on this woman as a suspect."
According to court documents, investigators did not end up taking any evidence from Damond's home.
Damn right!
Breathe Nana breathe
The Australians are already berserk that the now former police chief didn't bother cutting her vacation short to deal with this and took five days to make a statement.
Apparently, Australia expected this incident to have been treated seriously. Silly Aussies.
Don’t see the judge’s name... he should be impeached and removed.
Quickly.
This thing kind of puts the stink that Minneapolis has become right out in the open, hasn’t it. Corruption at many levels. We shouldn’t make categorical excuses for it at any level either, not even the “thin blue line” level. Maybe more like the fat white line of crack, or something akin to it.
This is so ripe for a look by the FBI, if it weren’t also in terrible shape.
Donald Trump could play this situation like Stradivarius’ very best violin, I bet.
Anything to protect the Jihadist cop Minnesota hired
Her fiance was out of town, he reported she called him before she called 911. I’m sure he will forever wish he didn’t tell her to call 911, but that is what we are supposed to be able to do for our safety.
I haven’t seen anything to suggest the fiance’s son was around, but I don’t know.
Possible justification for the city’s action:
She wasn’t wearing a burka at the time, so she was in violation of Sharia law.
She made a black Muslim look bad, so she had to be a bigot.
She was involved in a homicide.
She was present at the scene of a criminal act.
She took possession of city property, to wit, a bullet, without proper authorization.
By calling 911 twice, she made a police officer work while on duty.
I want the id of the judge that signed that warrant.
Yeah, I read that too. But seriously, I know of no remedy for 4th amendment search/seizure violations, other than suppression of evidence.
Can’t tie their kangaroos down, sport!
well a bullet in her stomach could be consider “a concealed weapon”
remember the Somali moslem must be protected at all costs...
Hoping to find something that might cast at least a shred of suspicion on the victim and make the incident seem less inexcusable.
They didn’t take anything and we will find out if they left something if they come back on another warrant.
Under modern civil rights statutes, which postdate the Warren court and its exclusionary rule, one can sue.
This does not make me angry, it makes me furious.
Doing everything they possibly can to deflect blame from a Muslim who is Black and a Somali. Trying to find anything to hurt her reputation.
They are so going to sue the police department, this is going to get them another few million dollars.
The family was already going to sue but this is going to just be gravy for punitive damages, they continue to inflict emotional harm on the family.
Australians just don’t understand that in the USA this shooting is widely viewed as a legitimate form of slavery reparations - certainly nothing white politicians are allowed to criticize or investigate.
In libspeak it’s all about the narrative. Start suspicion mongering on the victim to deflect the guilty. The victim that can never speak for herself.
The cop’s lawyer has already gone on record suggesting that she should be investigated for the possibility that she might have been under the influence of Ambien.
Agh! Surely she must have been a Muzzie-hater and did something to bring it on!
Sure. THIS Kumbaya lady?
