The only reason they have policies like this is because it is far too easy to litigate.
I believe they should caught, prosecuted and their likenesses put in facial recognition software to be shared amongst merchants with the immediate arrest for trespassing if they set foot in the store again.

There is something else. A shoplifter if confronted could do great harm if he/she has a weapon. It really makes more sense to watch the thief and follow him from a safe distance to see if he gets into a car/truck and then get the tag number.

I still remember decades ago going to Vegas when I was underage. The first casino, we got to play slots for at least 10 minutes before being confronted and kicked out (politely). Next one was about 1 minute. Third one we barely made it in the door.
If Vegas can do what you suggest, stores should do just the same. As far as I know, they can still refuse service (or entry) to ANYONE provide it isn’t race (or, now, bathroom) based....so that would be a great response, perhaps for an enterprising young millennial, wanting to be the next Suckerberg.
