I’ve been minimizing comment on this fiasco and just enjoying the show, but I agree with you. That airplane is private property. If at any time on the ground they decide not to serve a customer, they have the legal right to ask that person to leave (just like a restaurant, or like a girl who invites you over for “dinner” and changes her mind before dessert). When they asked him to leave, he was supposed to leave. It may end their business relationship permanently, but that is their right since the airplane is their property.
and what if someone asked for a gay cake?
Where did you get your law degree?
He paid for a service. The airline failed to provide such service for tae consideration that was paid to them.
Has nothing to do with private property. It is contractual law.
the ticket is a contract. there are consequences to breaking a contract. I hope Mr Dao takes United to the cleaners
I am amazed at how many freepers have defended this scumbag. He was refusing to obey lawful directions from law enforcement officers, what were they supposed to do, just leave him there because he didn't want to go? Everyone seems to ignore the fact they had him off the plane and he snuck back in. He got what he deserved but I expect the lawyers will make sure he gets what he doesn't deserve.
“Ive been minimizing comment on this...”
And you should have kept on minimizing.
By that logic you could walk into Walmart, purchase an item, head for the door and then Walmart would ask you to give that item back because someone else wanted it. Naturally ANYONE would refuse. Walmart would then call the police and they would take the paid item from you and haul you out of the store.
But if the passenger told the flight crew he wanted them to bake a cake for a gay wedding? Just asking....
Part of the purpose of law and government is to enforce contracts. The purchase of an airline ticket is a contract. That contract can only, legally, be broken under specific circumstances. This article is saying those circumstances were not legally met. Ergo, homie gettin’ paaiiiid.
Sorta like I can decide not to serve a customer at my bakery regardless of his choice of a straight or gay wedding cake?
Or sorta like I can decide not to serve a customer at my lunch counter regardless of his skin color?
