That would be the lamest argument I’ve ever seen in a courtroom. if I’m on that jury I would find for the plaintiff and award $1 in damages.

Totally agree. The lawyer on retainer is already pounding that "PC" avenue.

Bottom line : Whatever "excessive" force that was employed was totally induced by the violent neurotic or insane passenger with known anger management issues.
It may even be a cultural aberration (google air travel in China.) This kind of event is quite common in Asia.

This nutjob should NOT have been traveling alone.

The overriding objective in air travel management is the safety of the passengers, most of whom are normal, sane, and sober.

How many people do you know who would sneak back aboard a loaded airliner after being removed for any reason whatsoever?

If I were on that jury, it would a slam dunk. In favor of American Airlines.

he was not traveling alone. he was traveling with his wife.

united, by offering his wife a bribe, separated him from his travel companion at the time of the incident.

If the nutjob should not have been traveling alone, then united is at fault for isolating him from his travel companion.
