As soon as he left the house the immediate threat was over. He then had the opportunity to call the police and stay away from the intruder. By returning he re-initiated the confrontation and forfeited any claim of self defense.

A man has the right to confront someone who has invaded his house. Doesn’t mean lethal force at first, but it does allow confrontation. You make it sound as if the intruder has the right not to be confronted.

Jeez, what is this, England?? I mean what’s next, harming the intruder is against his rights?? That’s the way it is in England.
