The man went inside and confronted another man he found in his shower, deputies said. The homeowner left after the two exchanged words. "He returned home, retrieved a firearm, came back over to the residence and fired multiple rounds into the shower ... killing the intruder," said Mason County Sheriff's Lt. Travis Adams. The homeowner called 911 and told dispatchers that he had just shot and killed an intruder, Adams said.

From the sound of his “cooperating” with the detectives, it is not long before he gets to live in the big house.
By “my property my rules”, no problem.
By some sense of humanity and fairness, yes, there’s a problem.
Apparently the man was naked and unarmed in the shower. I might have hauled him out of there and kicked his naked butt, but I don’t know that I’d need to even grab a gun (although that’s helpful, but not worth going all the way to another property wherein he might run away) much less blow him away.

A classic and a very easy way to upgrade the murder charge from the second degree to the first degree. Instant 25 years addition to the sentence.

Absolutely correct. He should have lawyered up the moment he fired his weapon. Upon discharging his weapon, he should have secured the weapon, called 911 for the police and ambulance, and called an attorney while he waitedfor them to show up. We don’t know the facts as he reported that they had words. Had he called the police beforehand, they might have come in a few minutes, or not, depending on the department. We live in a remote area that it would be at least 30 minutes (at best, maybe an hour or not at all) before the law showed up...
And how the bleep could the homeowner know the intruder was unarmed? Always the wrong assumption.

You need to learn the difference between invasion and burglary. While, in general, it’s ok to shoot an invader, that is someone who knows you are home and comes in anyway, shooting a burglar can go either way. Imminent danger is the general rule.
First, this wasn’t a home invasion, at the most a burglary. The home owner left and came back, showing no imminent danger. He came back armed and then shot the guy. That shows intent. He didn’t call the cops until after he shot the guy. That shows premeditation. This guy will be very lucky if they don’t charge him with first degree murder.
I don’t understand why it says he went home, isn’t his shower in his home?
He’s really lucky they decided second degree. By leaving the intruder in the house, and going after a firearm. and returning with it there are couple of ifs:
1. was the intruder armed?
2. did the intruder attack the owner?
3. was the intruder a threat to anyone else in the house?
And if the answer to these questions is no, then he left the scene unarmed and returned armed and fired multiple shots into an unarmed man who had made no effort to do harm. The act of going after a gun gives him time to decide not to do harm and to call for assistance and not kill the man. This is the exact definition of premeditated.
According to Black’s Law Dictionary, which is the most used law dictionary in the US, “The term that is used to describe a murder that was planned in advance and was carried out willfully.”
If it happened as the article says, this guy should get the chamber.

Correct. This is what I have been instructed by my CCW (now in Texas it is license to carry) instructor and by Texas Law Shield. After the shooting, call 911, then immediately call the lawyer. In this case Texas Law Shield has an attorney on call. The police can not object to you talking to your attorney.
My instructor is a former state trooper.
Naked in a shower? Pretty sure he’s not hiding anything, even a knife.
Could be nearby on the counter, but the owner felt good enough to waste time turning his back to him and walking all the way to his actual house to get a gun and come back.
Add that it sounds like he just came in blazing to the bathroom, and you have someone “jumping the gun” a bit, I’d say!
