Attorneys for one of the two suspects accused of raping a 14-year-old girl in a bathroom stall at Rockville High School said the girl texted their client the day before the incident and agreed to have sex with him, according to court papers filed Monday.
In colleges, the woman can change her mind until the moment before penetration. Remember, no means no. According to these lawyers, a text the day before is proof of consent for a 14 year old. I don’t think so.
Actually, isn’t it the left that is making the argument that if rape is claimed, it should be assumed that the allegation is true, while the right supports the rights of both sides to have their case heard in a court of law.
I believe it was the left that so strongly sided with the woman in the Duke Lacrosse case.
Fact is she was raped by two illegals by two illegals, and media states she could be lying..
Now, I think you are probably right, but they need to get their day in court, just like the Duke Lacrosse team did. Sometimes it’s rape and sometimes it’s not. But we don’t have enough info to be sure, since we are not actually in the courtroom.
So we can only speculate.

I was originally not aware of the violence involved and do not know all the facts of this case. If, in fact, people heard her screaming and immediately after it happened she went for help, then even if she “consented to something”, the book should be thrown at these two.

Hate to say your right but you are. About a month ago at my sons middle school two eighth graders had sex in the boys bathroom. The school found out because apparently it was the girls first time and she was bleeding profusely afterwards and went to the school nurse and told her what happened. This school is not in the hood either, it’s a suburban school.

I’m not being ridiculous. I’m trying to see both sides. When I posted that I did not know what was actually done to her. If this played out the way it looks like it is, then even if she did send that picture, it will only be effective as a “mitigating circumstance”, and not much of one.
Maybe not with the younger guy.
Consent laws allow some leeway in like-age sex, usually with a 3 year age disparity. Depends on the State.
With the older guy it is definitely statutory rape though ... even if they can prove consent.

Most States have 3 year age difference consent laws.
Why haven’t These suspects had their age checked. I think the one whose picture has been published looks to be 22-23. Sit them down in a dentist’s chair and see if any of the wisdom teeth have come in. I am not sure if there are other ways but the authorities should know. The lack of a beard or whisker shadow means nothing among people with a large degree of Indian mixed with their Spanish ancestry.
If they prove to be lying about their age then they are guilty of statutory rape at the minimum.
As an irrelevant side note, I walked into my favorite bar one night and was served by what looke3d to me like a sixteen year old kid. John the owner who had hired him told me he knew the guy and said he was of age. I asked the “kid” later how old he was. He showed me his license and he was 33. Oops, unusual, even rare, but there are such people.
As I understand it, the statutory rape definition in Maryland law has an exclusion for less than 4 years age difference provided both parties are over 14.
In MD, this is not statutory.
