I disagree to one extent: On some things the President doesn’t have to give a rational reason. He doesn’t have to justify why he is doing what he is doing to a bunch of robed eggheads. He has been given absolute discretion on immigration, and his basis can be completely arbitrary, or because, as the arabs say, it is his pleasure.
The existing 9th circuit judges can have the territory of Guam. New Trump appointed judges can cover the rest of 9th circuit territory.

Yes but it changes nothing because it did nothing to overturn the three judges ruling.
It is simply cover so people might think that the 9th Circuit is not quite as looney as it really is.

It’s written opinion of several Justices on the 9th circuit about whether the case should be heard en banc.
How many judges are on the 9th circus????
Maybe something like:
“In light of serious national security concerns, combined with horrific instances of gross judicial overreach, it is hereby ordered that, in the interest of fairness, all immigration to this country - regardless of the country of departure or the religious affiliation of the persons seeking entry - will be suspended until such a time as adequate security measures can be put in place to ensure full and proper vetting of each individual seeking to enter our great nation. Of course, waivers and special exceptions will be necessary in certain cases, so we’ll be implementing the “Elected Official Foreign Visitor Sponsorship Program” which will allow officials elected at the federal level by the American people to personally vouch for foreigners for whom they will also personally be responsible. Any civil or criminal acts resulting in harm to America and/or any of her people will be the joint responsibility of the foreigner and their sponsor and any fines, incarcerations or other punishments will be meted out as if the sponsor and sponsee were co-conspirators in the commission of the act(s).”
That was a cringe-a-thon that would have me send in my resignation if I was one of the three communist globalist “judges”. I’d plead for my firing squad for sunset.

More likely, they heard Congress making plans to dissolve the ninth district court.
Except it can be used in impeachment of the other three or in breaking up the ninth.
