The case dates to January 2014 when Reeves, then 71, confronted a man in a suburban Tampa movie theater about texting during the previews before a showing of "Lone Survivor." The two argued, and then Reeves walked out of the theater to complain to an employee. When Reeves returned, he and the man, Chad Oulson, began arguing again.
Oulson threw a bag of popcorn at Reeves, according to a criminal complaint, and Reeves then took out his handgun and fired at Oulson, killing him.
Defense attorneys asked the judge to dismiss the murder charge under the "stand your ground" law that allows residents to use deadly force when they fear death or great bodily harm.

That sounds like great fun! I remember my mother always ordered a fried shrimp and vegetable egg-roll type of appetizer that she would allow me to sample. We were supposed to be asleep after the first movie, but I always pretended and watched both movies. It was wonderful.
My siblings and I would be in the back seat like a pig-pile of puppies.
When you deliberately and repeatedly cause confrontations with people, and you are regularly armed, everybody knows how that story is going to end eventually. It’s not necessarily per-meditated murder, but it was inevitable murder. Problem with the defendant “feeling threatened” is he started the fight, he turned it physical, the other guy was defending himself. If I push you first and you defend yourself and I start losing I don’t get to “feel threatened”, I’m the aggressor, I made YOU feel threatened.
I don’t think he was necessarily looking to shoot someone, I think he liked enforcing his authority. Of course as a retired he technically didn’t have any authority anymore. If you wander the earth starting crap eventually crap’s gonna get ugly.

In other words, I’m not insane. And I believe that is the only credible defense in this case - some form of a temporary mental insanity plea. i.e. the shooter just snapped.

No way you can know if the person disrupting the theater and assaulting a much older man was going to become even more violent toward the elderly man.
Does an old man have to wait until he is attacked to the point of injury for SYG to be valid?

It was usually tougher to watch a movie from the back seat, that’s why we would head for the car roof with blankies and pillows.
We had to try not to move around too much, tho, so as not to make too much noise for those below us.
But half the fun was just being there, eating the snacks (both bought & smuggled in, ha) and watchin’ something together.
Those were the days. There’s an old drive-in not too far from us but we’ve never visited it. Maybe this summer.

My thinkin’ is that if a guy’s really worried about being severely injured by popcorn, then he really shouldn’t be leaving his plastic bubble.
This is simply a case of a guy who was on the edge and just snapped. I have zero doubt that’s what the legal process will end up with - some type of unintentional heat-of-the-moment manslaughter.
Many police officers are trained these days that it's Confrontation Uber Alles.
And SWAT teams live to "confront".
And their captains and leaders? Hmmmmmmmmm...

That’s a specious comment that doesn’t address the point of whether or not the popcorn was a precursor to a more serious physical assault.

In my neck of the woods you wouldn’t want to go to one during the winter even if you could find one that’d be open.
There are still maybe two still around nearby in my area. It’s a wonderful piece of Americana that is barely hanging on - so catch the memories while you can!

This is not consistent with the established facts.
The old man went so far as going to ask the theater management to ask the deceased to stop his behavior which was disturbing the other theater goers.
That does not comport with “picking a fight”.

My brother-in-law is a former Marine, and retired law enforcement.
He ALWAYS carried, usually more than one piece. The unspoken threat with him was always there. He is a big guy, and I'm bigger - but I was always aware that he was dangerous, partly because of his training and attitude towards "civilians".
I would say this Reeves guy is more dangerous than my brother-in-law - and that's saying a lot.
It doesn't like me in the slightest. 😀

Agreed...I carry ALL the time.
BUT
It has ‘made me’ or— at least in my old age— ‘turned me into’ a better driver, ‘nicer’ person, avoid confrontations with strangers or people I do not ‘know’ all that well while sticking to my ‘image’ as a sarcastic, sardonic personality.
My sarcasm tends to remain on the ironic side rather than confrontational.
Never was much of a fighter, usually avoided obvious situations and used the ‘gift of gab’ to keep the fighting to a bare minimum.
