On December 23, the Senate voted 60–39 to end debate on the bill: a cloture vote to end the filibuster. The bill then passed, also 60–39, on December 24, 2009,

Right -- I forgot about the whole Senate amendment bill that was ultimately passed by the House. The Senate couldn't vote on the bill again because Kennedy had kicked off and Scott Brown took his place as the 41st GOP senator that would have upheld the filibuster.

It may all be academic anyway, since I suspect an ObamaCare repeal/replacement bill may have some support among very vulnerable Democrats in states that Trump won.
