Roughly six months ago, Ever Valles was arrested by Denver police on charges of illegal possession of a weapon and vehicle theft. The suspect was reportedly flagged by Immigration and Customs Enforcement (ICE) as an immigration enforcement priority," given his known gang affiliation.
A detainer request was put on Valles, asking the city of Denver, a so-called sanctuary city to notify them before he was released, so they could take him into custody. However, Denver released Valles December 20, and ICE claims they were not properly notified.
Almost two months later, tragedy struck.
On February 17, Valles was charged with first-degree murder for the death of 32-year-old Tim Cruz. A second suspect, Nathan Valdez, was also charged with murder. Both suspects were also reportedly charged with multiple counts of aggravated armed robbery and kidnapping.
Valles and Valdez are accused of robbing the victim at gunpoint before killing him at around 1 a.m. on Feb. 7. ICE described Valles as a known gang member and citizen of Mexico.
Due to his criminal history and gang affiliation, Valles is an ICE immigration enforcement priority, the agency said in a statement.
The Denver Sheriff Department claimed it alerted the local ICE office of Valles release at 11:33 p.m., on December 20, roughly a half-hour before Valles was released from jail. ICE, however, argued they didnt receive any fax until about 38 minutes after Valles had already been set free.
The detainer wasnt honored, ICE said in a statement. The issue of sanctuary cities has become a hot-button topic since President Donald Trump took office months ago.
In one of his first acts as president, Trump signed an executive order calling for an end to sanctuary cities. He has also threatened cut federal funding for sanctuary cities that refuse to cooperate with federal immigration authorities.
But I would bet that at least one juror in any criminal would hang the jury.
Everything has a price.
I agree. Its time to start prosecuting judges and politicians who are aiding and abetting criminals who commit crimes against Americans.According to one numbskull on this thread ICE is to blame...I'm positive other liberal/progressives would agree. It's always someone else's fault.
Perfect.
If these Sheriffs and city politicians don’t wise up some folks may take the law into their own hands.
Round up the illegal alien murderers and rapists and the LEO’s and politicians who enable them and string them up and let them strangle slow like.
The fuse is burning, what happens when it reaches the charge is anyone’s guess.
Screw the lawsuits. Arrest and charge the police chief and mayor with aiding and abetting, harboring, and trafficking illegal aliens, and for issuing edicts that force LEO’S to violate federal immigration laws.
It’s not the cops on the beat that are the problem. It’s their leftist shitbag superiors and the scumbag politicians lording over them that are.
If the DOJ and DHS make an example out of just a few of the corrupt politicians, the rest will fall into line pretty fast, or end up in a federal penn.
There’s the problem. ICE “asked” that they be notified at a later date. No. ICE should go in the minute they’re aware of an arrest and take custody of the person. If the city/county wants the suspect back for a court date, then they need to ask ICE to drive him over for the day and he still belongs to ICE.
Yep. If I am a train engineer, and I intentionally disregard legal guidelines for operation of trains and someone is killed as a result, either my company or myself is going to pay.
And that is how it should be. Accidents happen. Murders and assaults happen. But when they happen because the laws of the land are intentionally disregarded, someone should pay.
To constitute depraved indifference, the defendant’s conduct must be ‘so wanton, so deficient in a moral sense of concern, so lacking in regard for the life or lives of others, and so blameworthy as to warrant the same criminal liability as that which the law imposes upon a person who intentionally causes a crime. Depraved indifference focuses on the risk created by the defendants conduct, not the injuries actually resulting.

I wonder if trump can sue, or join in an existing suit? Seems like Obama did that a lot. Liberals need to be fought any, and every way possible.
If US citizens killed the illegals becore the illegals could kill US citizens, the we wouldn’t have any US citizens killed by illegals, right?
To hell with lawsuits, the victims’ family should wait til cover of night and track down anyone and everyone responsible for allowing this and “share their pain” with these a-holes.
Every guy released and then there’s a major felony, murder, rape or armed robbery by said individual automatically gets an arrest of the Mayor and City Council as accessories. That will put the kibosh on it. Have them arrested, booked and to jail for awhile and then fight it out in the courts. They can walk around with ankle bracelets.
I say it’s way past time to start putting some of these city folk who purposely break the law like that in prison. For a long time. A long, long time.
Putting the public in mortal danger.
Just need to put 3-5 of them in prison for life. I know it’s a lot to ask but they ARE responsible and should be held accountable.
I'll explain this so even you can understand. Maybe
ICE has two choices --
1) They can merely request a jail to hold a person after they are otherwise free to go. But, federal courts who have considered the issue have (so far) unanimously agreed to hold a person after they are free to go is a Fourth Amendment violation. Plus, counties can be held financially liable for those violations.
2) They can go to a judge & get a warrant to hold the person longer.
When ICE does not do #2, while the jail complies with the Fourth Amendment, then who's fault is it when an illegal immigrant gets out & does something wrong?
Get the biggest junk yard dog attorney and sue them.
I happen to agree with sanctuary cities. They should provide sanctuary - to legal U.S. residents.
Illegal Alien status should be a major aggravating circumstance for any crime.
